      Have had a response - of sorts!! In summary the letter says - have receieved your letter and we are passing it on to the relevant department who will be in touch.

      I think this is a basic "sod off and we will deal with you when we feel like it" reply. On the plus side at least they can't say that they didn't get my letters!!!

      Please could anyone advise me on what is my next step is please????

        I've been informed they are having a Xmas sale and are willing to give me a 30% discount on my unsubstantiated, statute barred debt.

          Will they throw in a cracker and and a santa hat too???? They have more bottle than unigate!!!

          What is my next step? They seem to be off in their own little world (bless 'em!!) how can I bring them down to planet earth and get them to supply the required documents??

              Ok - am just concerned as the balance they quote is getting higher each time them send me a letter. Would like to get this sorted as i am really concerned they will take me to court or do something to affect my credit rating as we come off our fixed rate next year so want to make we can move our mortgage if we need to - last think i need are these idiots stuffing things up for me.

                  So its a wait and see what if anythign they do next situation??? I have checked my credit file but couldn't see anything on it from them - do I need to keep checking this every couple of months incase the little devils sneak something on? I know they aren't supposed to, but then again they aren't supposed to demand payment for a debt they can't prove.......

                  What do I do about getting the payments I have made back???? I really don't think i ever owed this money, i thought the debt was settled but because i couldn't prove it they told me (verbally) that if i didn't agree to a payment plan they would issue a CCJ against me, so i made the payments just to settle the matter down. I didn't know that they were charging interest either!!! The "debt" has risen by £3,000 despite me making £720 worth of payments!!!

                    As they haven't filed anything with the CRA's I'd say they have no intention of doing so.
                    Alot of their letters are implied actions anyway.

                    I'm still looking into the whole reclaim due a mistake of law.

                    They don't have the agreement in any form, so they can print any number they want as it's COMPLETELY meaningless

                    BTW you owe me £15,932.02 for my advice to date according to the agreement that you signed with a third party. This will increase at any rate I feel free to add when I feel like it.

                      I know i am a really panic knickers!!!:fear: but i just panic incase they trying taking a CCJ out and it affects my credit rating - plus my hubby was none too impressed when he saw the letters, he did calm down when I told him the full story but he is worried about it (he doesn't subscribe to the forum and doesn't really understand all the implications etc, he is just happy to let me deal with it all)

                      Thanks so much for all your help - i'll try and untwist my knickers and calm down a bit!!!

                      Still want to get the little devils for demanding false payment tho!!!!! :fencing:

                        They wont simply take out a CCJ against you.
                        This is a long process and we WILL fight them hard if they even consider it

                                Well they have truely sailed past the letters deadline and have not responded with any paperwork, so I can only assume they do not have required or correct documents - despite the letter statign they had but wanted proof of my residency in 1996!!!

                                Should I send them an SAR as this will gvie me proof of all the payments I have made - once I have this can I send them an LBA requesting the return of the payments i have made as they had no legal right to request or accet these payments?? From their last phone call they stated I had made £720 worth of payments, so could I just LBA them on that basis????
