    Hi,

    I have sent a letter to CAP 1 & MBNA explaining that I can not pay the required monthly payments and have offered them £110.00 per month each.

    So far I have had lots of phone calls from CAP 1 and also from RMA (MBNA) but they have not said if they accept my offer or not. I have sent a request for my CCA to both of them.

    Do I need to send a letter telling them that the account's are in despute or not.

    Not sure how to go about this the right way so any help would be great.

    Are the accounts in dispute ? ie are you reclaiming charges from them or are they past the 12 working days for the cca response ?

    Start (and continue) paying them the £110 a month as you offered and keep records of payments to stand you in good stead later. I wouldnt stop paying based on their default under the CCA - I'd keep pushing for it until you get a final answer one way or other else you risk court, DCA and credit ref agency actions.

      I am not reclaiming costs from the accounts and the CCA requests become due on the 26/10/09 I will have a read of the link and see if that helps me understand this any better.

      Sorry to say that this is a little over my head at the moment so I may have to pester you again.

        Hi Again

        Recieved a reply from Cap 1 to my CCA request and got the same set of doc's as Mike 770 recieved with T&C sheet and charges set at £12.00 and an updated version of new T&C with a revision date on the bottom of 09/09.

        I have not had anything from MBNA so do I send them the same despute letter as Cap 1?

        Sorry if this is a daft question but I do struggle to get my head around this!

        Update: just taken a call from RMA refused to go through security checks on the grounds that I have no dealings with them and got called a liar!! just as a matter of intrest are RMA a inhouse company of MBNA or not.

          I believe RMA are just a collection arm of MBNA based in India.

                RMA just a DCA monkeys MBNA use, they will not have been assigned the debt if they had you would of been notified by MBNA, ignore them, or send harrassment letter to RMA & no they are u.k. based, you will get a card from Mr Green saying he will call you, forget it more trash can junk.:haloweeeeen:

                        You said you haven't put the accounts into dispute and are not claiming charges. Is this because there aren't any charges to claim? Because tbh if there are charges then claim them, both Crap One and MBNA were ridiculously easy to reclaim vast sums of money from IMO. In fact MBNA were even easier than Crap One. Depends on your tota;l debt of course as to whether you would rather go charges route or CCA

                          Not sure about the amount of charges on the accounts, but I was thinking of sending a SAR request but I was not sure if you could do both.

                          I have also sent both of them dispute notices today, should I still pay them a nominal amount or not?
                          As I said before sorry for any daft questions but this is a "black art" to me!!

                            Hi,

                            I have still not had a response from MBNA ref my CCA request, is it worth sending a reminder?

                            This morning I got 2 letters from CAP 1 telling me the account was in arrears and they are adding another £12 charge, no mention of my account in dispute letter. Should I respond with a copy of what I have sent them?

                            Any advice would be welcome.

                              What are the amounts involved i.e how much are the balances on the accounts? It won't hurt to send SAR. As I said earlier, if your charges are more than the outstanding balnce I would go the charges route rather than CCA.
