      Re: Shooter V Capital One

Sorry, I should have been clearer in what info I wanted
So with that in mind here are a few of questions to start with...

      1) Should I have received anything in writing about lowells from capital one ie; Notice of assignment

      2) I know I have so far been unable to post a copy of what they sent me and I know that without actual sight of what was sent that it's going to be hard for anyone to comment but...

Does it sound as though what I have been sent is a credit agreement that fulfills their obligation under the CCA74 request

"I have been sent the signature side of a letter that does infact have my signature in my handwritting in a box that says Credit Card Account Agreement, it is on what appears to be one side of a letter envelope there are no prescribed terms and conditions with it only a copy of the current T&Cs

Also theres a copy of a screen shot regarding the default on my account and template default letters."

      3) should I be sending Lowells the account in dispute letter as they are the 3rd dca that have contacted me (dispenced with the other 2 last year)

      4) Do Lowells have any specific tactics that I should look out for?

      5)

whats the reasoning behind this. I've never dealt with Lowells before so have NO knowledge of them, but they don't seam to be a pushover from what I've read on other forums

OK well with out a scan it's difficult to comment on the agreement, so I wont at all.
If you could scan it that would be spiffing.

As far a Lowells are concerned simply send them a dispute notice and get your claim with Cap1 sorted out.

Does your "agreement" look anything like this one?

          Thanks

I'll have a look but I dont think so

I'll try and get it scanned today as friend who knows how to use a scanner is coming over later.

Sorry if I sound stupid (hopefully I don't) but I have a few questions

Having read a tread otr I am left wondering should I have received a Notice of Assignment from Cpital One, Lowells and Reds? (yes I am now receiving letters from them also)

cause if so I haven't received anything like it from any of them so am I right in thinking that as I haven't that they (Lowells and Reds)? are breaking the law

Don't get hung up on the NoA as DCA's are well known for "creating" these themselves.

Quite normal I'm afraid, especially from my Friends in Leeds.

So did you ever get the "agreement" scanned ?!

No sorry I didn't seems I was doing things right but the scanner I was using is caputz! so my friend is bringing theirs over when they next visit which should be this week

Not having much luck with the technology in my house at the moment even the DVD player won't work, can't even turn it off without unplugging it and now it seems to be holding the disc hostage! LOL
