    Still nothing from either Natwest or Irwin Mitchell - or the Court !
    I'm obviously thinking about the 'huge' spreadsheet I complied and forwarded to you - I'm basically hoping this will almost 'cancel out' this claim ?

    I did check my credit file, yesterday, and despite having already Defaulted me Natwest are continuing to add interest at approx. £60 per month - no company have ever added interest after a default before ?

    Look forward to your thoughts, when you get a chance to have a look.

    Again sorry to have 'hassled' you, my dear Budgie and I'm very grateful of all your kind assistance, to date.

      Hi Budgie / Ame,

      What I was getting at in my post of a couple of weeks ago is the fact they (Natwest) have said that if they don't hear back within 8 weeks then they'll consider my complaint closed !

      Surely if I let this happen, and my court stay is lifted, further down the line, then I run the risk of having lost my chance to defend ?

      Bearing in mind Budgies belief that my original charges claim was far, far less than it should have been should I put a copy of my recent spreadsheet into them now (Budgie is currently reviewing this) ?

      I think a response may be important ?

        hi xx do you want to send me the spreadsheet to go through now? I think Budgie has been tied up a lot at work as I havent seen much of him so I'm happy to help you with the next steps. I'm not an advocate of Compound/Contractual Interest tho and with the current position legally on charges being so up in the air I wouldnt push any claim into fast track that neednt be. Have you checked with the court if there has been any movement on the claim ?


        The natwest letter about the charges shouldn't affect court but yes a reply might be in order just so they cant use inaction against you later in anyway.

          I must emphasise that due to the volume of information on this spreadsheet its just not possible to remove all the private stuff - hopefully you're OK with me sending this, as it is (this is what I did to Budgie) ?

          BTW I have received a LBA fom Shoosmiths, today, giving me less than a fortnight to revert with my repayment proposals OR they'll be taking action too !

              Thank you Ame.

              Yes Shoosmiths are now chasing me for the same, alleged, debt that Irwin Mitchell have been chasing my wife for !

              They (Shoosmiths) contacted me last October and I swiftly sent a CCA. They went quiet, until now when they've finally reverted !

              Interestingly the amount from both companies WAS they same (comprising of an overdraft + personal loan - split approx. 60/40). Shoosmiths have now docked my £1.00 CCA fee from the original amount (their first mistake) and have attached a copy of the, alleged, personal loan agreement BUT made no reference to the bulk amount - being the overdraft.

              Ironically the HUGE amount they are claiming is only a couple of hundred quid more than the total charge figure, on my spreadsheet (as just forwarded to you) !

              How do you propose I handle this Shoosmith situation - can two companies chase the same, alleged, debt ? Can Shoosmith really start proceeding for the same amount that Irwin Mitchell have despite their attempt being stayed in Northampton ?

              Perhaps I can feel a complaint coming on................. ?

                tbh its a ruddy nightmare and natwest do this far too much, did you ever read Ruby's thread about shoosmiths and irwin mitchell ?

                I think we have to ask for a strike of both and tell natwest to start over with One claim. Will have a look at your spready this morning and a look at some bits after school run.

                Can you scan the shoosmiths letter?

                            The Account fee and interest on the spreadsheet - can you outline what those charges are ?

                            Is it a standing monthly account fee (£5 / £6 etc) ?

                            Is the interest standard interest on the overdraft ? or have you split it so its just the interest applied to the charges element of the overdraft ?

                            I think from the figures you may have included ALL the interest they have charged you of which most will be legitimate interest on spends rather than on charges ?

                            also have you two accounts on there or just the one? If two i would split the spreadsheet so you have one per account.

                              Hi Ame,

                              I've just popped on-line, briefly, but unfortunately am now rushing out again !

                              Basically I supplied Budgie with two sets of figures, from two spreadsheets, that I had 'originally' sent to N/W by means of charge claims.

                              Budgie asked me to re-do these in the format I have now supplied you - I spent hours and hours compiling this document.

                              I'm sure Budgie had his reasons which is why I was really hoping he'd have been able to revert. I appreciate he's very busy at work now but I'm at a bit of a sticking point, it seems.

                              I'm really not sure what to do next andits now Shoosmiths as well as Irwin's who're looking like beginning proceedings.............

                              I will have to revert, in answer to your questions as the approx. 10 years of statements have now been filed back in the loft !

                                Okay, if you have included all the interest charged on the account and monthly account fees they have to come off.

                                Leaves ...

                                Charges £ 789.00 (theres quite a few refunds on it too which have come off the total)

                                Stat interest £386.17

                                Which yes is bad news, and I'll try get hold of budgie see what his thinking was.
