      Great news that the claim is now stayed.

      OK, next move is to prepare an argument to use with Irwin Mitchell to try and get the court claim removed altogether. To get the balance on the account reduced in respect of previously applied charges and associated interest and an agreement in place for repayment of any outstanding payment due in either direction.

      I am still reviewing your spreadsheet ( there's a lot to go through ) LOL
      Will get back to you in a day or so.

      But, suggest you sit back and relax a bit.

        Hi Budgie,

        Firstly I'm sorry if I have 'hassled' you but many thanks for your further assistance and kind attention.

        I'm obviously very interested in your comment about preparing an argument to try and get the court claim removed - this will be a further education for me (as was your fantastic advise and defence which has allowed me to achieve this stay !) !

        I appreciate my spreadsheet will take some 'plodding through' - it took me absolutely ages of painstaking work to prepare it and I was amazed just how much the total was !

        I guess now Irwin Mitchell has attacked my wife, instead of me, this still leaves me open for similar action - you may recall Shoosmiths had previously made a 'weak attempt' BUT they seem to have gone a bit quiet, for the time being anyway !

        I'll take you advise and sit back and relax, for a while !

        I eagerly await your thoughts on the HUGE amount of charges applied, my dear Budgie.

              Hi Budgie / Ame,

              Just an update.

              Still nothing from the Courts (claim stayed !) and still nothing from Irwin Mitchell (Natwests representative).

              HOWEVER I have, today (Tue), received a letter from Natwest.

              This letter doesn't seem to be specific to the actual court claim and instead appears to be a standard template one.

              I believe the content maybe applicable - it basically refers to my original (moneysavingexpert.com) charges spreadsheet and says due to the OFT's / Supreme Judgement of 25 November 2009 they are upholding my complaint and will NOT be refunding my charges.

              Thay have said if they don't hear from me within the next 8 weeks then they will regard my complaint as closed !

              I can't help feeling I need to do something, within 8 weeks, or I may lose any charges re-claim opportunity in my defence ?

              Hope you can please advise Budgie ?

              Also look forward to your comments re. my supplied spreadsheet and HUGE charges ?

                  hey rb - its just a template so nothing to worry about will have a ponder over weekend about if you need to respond in any way, possibly a yes ok but my complaint is at court so your letter is a bit irrelevant... type letter. Though it might nudge them on the claim continuing. really I'd wait for their next move - irwin mitchell do seem to run away as soon as someone stands up to them. So until you have a response from them, or you have a definitive move to make on your charges claim (ie once templates are sorted and first few claims are through so we know the situation better) you are best off on hold.

                    I'm glad Budgie is OK !

                    By the sounds of it you're not surprised that I.M. have "run away" then ? In your experience what is likely to happen next - are they reknown for applying to the judge to have the stay lifted and case re-instated OR will this just sit on 'stay' forever ?

                    PS What I was getting at was the fact they (Natwest) have said that if they don't hear back within 8 weeks then they'll consider my complaint closed ! Surely if I let this happen, and my court stay is lifted, further down the line, then I run the risk of having lost my chance to defend ?

                    I think a response may be important ?
