        Todays the 'deadline day' for I.M. to respond to me / the courts !

        Nothing until now but I'm still not 'counting my chickens' !

        I'll try and telephone Northants Court tomorrow (Tue 5th) just to be 100% of the latest situation.

        I also eagerly await Budgies thoughts following on from my, lengthy, charges spreadsheet ? This will be vital over the coming days and weeks, I guess ?

        I'll get working on the budget in the next day or two - looks pretty detailed and lengthy !

              Hi Budgie / Ame / "Anyone else with Natwest / Irwin Mitchell Experiences",

              Just to update I called Northants CCBC, this afternoon (Tue 5th Jan), and it was confirmed that:
              a) Natwest / I.M. had until yesterday (Mon 4th Jan) to reply to my defence,
              b) Nothing has been received from them, by this deadline at all (or today, Tue 5th).

              I asked if this claim has now been 'stayed' and was told that this hasn't happened yet BUT she anticipated it going on overnight tonight or maybe tomorrow - although she didn't seem 100% sure ?

              It was confirmed that once the stay is put on they (Natwest / I.M.) will then have to apply to the courts to have this lifted !

              So everyone my question is now - What do we do next (if anything) ?

              What is 'likely' to happen if I do nothing - from everyones experiences ?

              How's the review of my charges looking, my dear Budgie ?

              Hope to hear back soon.........

                Nickij v Natwest/Irwin Mitchell - Legal Beagles

                Is another IM/natwest claim, we defended asking for more information and the case got generally stayed and IM just kind of went away and they have let her just get on with making the payments as she was doing before they took action against her. So have a read through that

                      Just an update....

                      I have phone Northants CCBC, again, this morning, and they have now confirmed that a stay has been put on this claim (on 5th Jan 2010) due to Natwest / Irwin Mitchell not responding to my (FANTASTIC, LEGAL BEAGLES !) defence !

                      I didn't realise that there is no expiry on these "stays" so it effectively sits there 'in limbo' forever UNLESS they apply to the District Judge to have it lifted, of course !

                      Budgie / Ame - is this the result we were hoping for ?

                      In everyones experiences what is likely to happen now ?

                          I don't think we've spoken before so thanks for your contribution and kind comments !

                          Is this congratulations though ? I'm a 'newbie' so unfortunately not as 'well educated' as my learned colleagues here, on Legal Beagles !

                          I'm not really fully sure / clear exactly what this (stay) means - particularly with regard to likely action, from here on in ?

                          PS I've just checked my credit file and Natwest have defaulted me (in October 2009) AND further more added over £120 of extra charges during Nov 09 and Dec 09 !

                          Unsure what to make of this now ?

                          Defaulted me, tried court action and then they seem to have given up on the action BUT still defaulting me / us (joint a/c) ?

                            Hi (again) Ame,

                            I've now read through Nickij's post - very interesting to recap on this (as I did read, and post, when I first found LB).

                            The difference is she's been very good and making regular payments whereas I've not done that at all !

                            I've submitted my REVISED charges spreadsheet to Budgie and the total (with this different interest calculation) is approx. equal to the claim amount, from Natwest / Irwin's !

                            I guess, one Budgie reverts, I need to be making some type of offer to Natwest now, do I ?
