        HI All,

        Just a quick update...

        I have taken an alternate option and it seems to me I am drowning them in paperwork... ...Ooops

        I have re-sent initial dispute, SAR, requeted contract agreement, responded to compliance department who have acknowledged the dispute, A response to the telephone conversation with the branch manager and enclosed FSA/PN/115/2005 re PPI, OFT Debt Collection Guidance and the statement that I had received not in a legible form... ...Phew!

        I also sent copies of all the above and further letters to The Financial Ombudsman, FSA, Compliance Department and Head Office.

        If they did not hate me before... They must hate me now

        Have I missed anything?

          Looks like you are hitting them hard......best way to do it is to put pressure on them and let them know you are serious.....lol....

          Did they cash the £10 cheque for the SAR??....check with bank who cashed it....
          Did they cash the postal order??.....contact Post office with the postal orders number.....copy of number on your post office receipt.....they can trace who cashed it.......
          Did they sign for the delivery of the Recorded delivery??....see royal mail website for copy of signature....

          Did you put something like....

          Dear sir/madam,
          Please find enclosed copies of the convieniently lost or misplaced documents you claim not to have received previously. I am sending them to you again after being advised by your staff that you cannot find them. They were of course sent recorded delivery to you so I shall be seeking a copy of the signature your company supplied Royal Mail at the time. I also sent a Postal Order and kept a copy of this and shall be asking the Post Office to investigate if it has been cashed or deposited. If as you say, you did not receive it then it will not have been cashed by your company!

          It also appears you have cashed a cheque sent to you specifically to be used for my Subject Access Request, thus proving delivery of the documents to yourselves.( Only if they cashed the cheque and you can prove it )

          ( If you check and see if they got payments and signed for documents they are stuffed! )

            Ask how many points you were sold for your PPI.
            1 is a single person
            2 is a couple
            4 is a family

            Ive watched many account manager make a nice monthly bonus from selling a single person a family insurance policy of which they had absolutely no need.

            Welcome are well aware this behavior is being carried out in its business.

            Your change over of staff, is due to the job and the loss of soul for wages.
            Some opt to keep a soul, many just get exhausted.

            Welcome are not a nice company to work for or owe money to.

            I hope you keep them on the run, i can promise you no one in your local office will have a clue what the paper work is that you are sending in. they will have no department in store to deal with nay of this.

            Local branch will ignore and blag as much as possible, don't accept any of it.
            If necessary go into the branch and request paperwork, they can print out every thing from their desktops.
            All paper work is still hard copy and in a folder in the filing cabinet at your local branch head office get a copy of your agreement, you get a copy , and one stays in branch.

              Many thanks, I did not realise it was on a points basis I will ask them and see what they say lol. I should be receiving lots of telephone calls on Monday... ...Will ask them to respond in writing pmsl.

                Hi All,

                A quick update!! I had 4 calls from Welcome on Wednesday so I called them back in the evening when I finished work... ...I talked to a chap there who demanded payment, I explained that there was a dispute and to refer to all the paperwork I sent regarding this. He, in not so many words, told me it was my credit rating and not his, oh yeah, he also told me they were going to sell on the loan to a collection company!! I told him to refer to the OFT statement regarding this!!

                Does anyone have any idea where I stand on this and as they are constantly putting charges on this. I want to know what can be done. I talked with the Financial Ombudsman Service and they have told me that they are within their rights to sell it... ...This is going to be a long process!!!!!!!

                Am I still able to dispute this even if it goes elsewhere?

                Sorry, I am still trying to work out how to go about this

                  i have disputed things that have been sold on ,and successfully too!
                  if they do sell it on then send the company the same as you sent them,the OFT saying it shouldnt be sold on while in dispute and that it is unlawful to try and enforce payment whilst it is in dispute.they normally back off but it depends on the DCA.some are quite good and others a nightmare.you could also ask that the DCA hand back your debt to the originators as it is in dispute.
                  my ex had a loan with these "people" he is going to claim claim back £12000 in mis sold PPI! go for it.i know it takes a long time and it very stressful but its worth it in the end. and when you get the money the debt can be paid off in full and you can tell them where to stick it all!!!!

                    You should complain about there ahaviour but unfortunately the OFT don't deal with cases for individual consumers, they just set guidelines and deal with mass complaints such as those brought by CAB.

                    Complain to the FOS they must be bored out of their heads at the mo!!!!

                    Personally I am in a similar situation with a different company and just keep replying to their letters with my previous ones and the OFT report, up to now we're on 31 pages and they have just referred it to 'another' DCA who they have already told me in a previous letter is one of their group of companies, when we're up to about 100 pages, or a dozen referrals, I'll be ready to put a complaint in about them, in the meantime I'm quite enjoying writing my 'fob off' letters, I may even start using a template soon!!!

                      Phew, now believe me when I say, that is a weight off of my mind :banana:!

                      Even though the debt is in dispute they are still putting charges on!!! Never mind I will get this back ... I hope. lol. At least I know I am okay to stick to my guns!! I will get a letter off to their compliance department regarding that particular member of staff!! He was quite rude pmsl. the chap at FOS who dealt with the initial complaint is still dealing with my case file as it grows larger by the week. He was very good and I will copy him into the letter of complaint .

                        If you have a man dealing with your case at the FOS, i don't see how they can say Welcome can be in thier rights to sell your debit on?, surely if its unresolved problem with the FOS then it stays in dispute and can not be processed? isn't this the opposite to what has been used to date on the forums?

                        I have not known Welcome to go to court, I have been out of the link a while now, so if anyone knows someone or has been to court please holler.

                        Welcome are seen as the bottom of the bucket lenders, when DCA's have the debits they know full well there is either a none payer ( runner) or a high chance that the account has a seriouse issue from its making.

                        Not sure who they will sell it too, used to be an in house sleezy set up, wouldnt surprise me if that hasnt changed, no one wanted thier cases then , would be surprised if they would take Welcomes cast offs now, not a very secure bases to build a company..especially in the new light of consumers learning thier rights.

                        Dont be put off, Ive heard some nasty threats made at customers over the phone, one included a base ball bat, and this was in front of the office manager, who is now area manager!!! the employees are as bad as the company let them be.

                        and start RECORDING, you could loose some good stuff, one threat of violence and you could have a police involvement, every sentence counts.

                              I would love for one of them to threaten me, although, I suppose in a way he did

                              I was at work and missed a letter that had been sent recorded delivery!! Will have to arrange collection for tomorrow, I am waaaay too busy at the moment!! pmsl. Letters are all being sent today... ...More I hear you cry!!

                              I am going to talk with the guy that is handling my case file today and I will see what he says, I understand that they are not an advisory service, but as Pam says... ...They must be bored!! Do you think it is worth sending all the documentation to Cattles?? I may have a go and see if this hurries them on :banana: lol. Thanks for all your help guys, I will keep you posted.
