      The judgment needs setting aside on the basis that you were in hospital and therefore unable to file the acknowledgement and subsequently your defence.

      You need to file an N244, this usually costs £75, but given your circumstances you will qualify for remission or even exemption and we'll help you fill it in.

          This is the form Amy mentioned, I have put it on so you can have a look at it. On there it also gives info on what everything means.
          On the next bit it gives you the criteria for remission or exemption of charges.

            Righto, not a problem honey.

            Yep need the N244 and ask the judgement to be set aside on the grounds of you being ill over christmas, we'll also attach the defence/admission.

            3.What order are you asking the court to make and why?

            Defendant is requesting the default judgment be set aside and the court accept the partial admission, defence and counterclaim attached. The Defendant was hospitalised due to illness on XXX until XXX and has not been in a position to enter her documents on time. Under Civil Procedure Rules Part 13 (1)(a) the defendant has a real prospect of successfully defending the claim and (ii) the defendant should be allowed to defend the claim.

            any probs with the other bits shout Will sort the defence after shopping. its okay you should have 14 days from the 9th to get this in so tomorrow will be fine

            You will need your IE sheet and your spreadsheet of charges? plus we'll also use the non reply to the part 18 request and defend the collection charge as excessive and a penalty, and make an offer to pay on the part of the debt which you agree with.

            You also need to complete the EX160 (on that link Nelly gave you) and get together corresponding docs to ask for fee remission.

                    Sorry for the delay my depression has got the better of me at this present time but trying to get on with things now again all i sent to the court was the form that you gave to download and i filled it out and am waiting to here back but did get a letter from northampton court telling me that it has been passed over to wellingborough for inforcement ??
                    on a different note i am now being chased by the credit company about my arrears on my car and they are telling now that action is going to be taken against me and take the car back and sell it in auction and i will be liable for the outstanding amount ??
