    Which is why this s.78 issue matters so much with statutory demands because they can be set-aside on the basis that the rubbish sent by the creditor in support of their claim for a debt by bankruptcy is questionable, so the issue of its *honesty and accuracy* should be tried in the county court and not the BR court.

    That's how PT got shot of my scary SD a couple of years ago

        Yes they can, it was established on Carey vs HSBC that demanding payment (a.k.a. collection) does not constitute enforcement.

        They can even issue court proceedings, however, if you submit a suitable defence, they won't succeed in obtaining judgment. This is very likely the reason Lowell so often choose the insolvency route as opposed to the much more appropriate county court route. The prospect of bankruptcy is enough to scare many into paying without thinking about it. It's big time abuse of process yet they seem to get away with it time and again.

        Fortunately for us, Cel knows how to handle the lowlifes.

          Even worse is when the recipient of the SD knows that they do not owe any money.

          There should clearly be some sanctions that could be applied to the issuer of Statutory Demands that have been set aside.
