CAB response to consultation on this.

    http://www.citizensadvice.org.uk/ins...on_to_send.pdf

Worth reading all the way through, as it addresses not only the threshold, but pre-action conduct and the whole process.

The consultation stopped the government changing the rules to cut court out of the process for creditor bankruptcy petitions. Thank god.

Page 9 - 22 is the relevant section on the CAB report. The whole consultation and government response is http://www.bis.gov.uk/insolvency/con...ition%20reform

Yep. Creditors petitions will still have to be heard by the courts.

Debtors petitions will switch over to being heard by an adjudicator at some point. See schedule 18 of the Enterprise and Regulatory Reform Act 2013

Re: Bankruptcy - Scarier than I realised

Oh, on an slight tangent that may interest some, it has now been confirmed that the repeal of the early discharge provisions for bankruptcy are going into the Insolvency Rules effective from Oct 1st 2013.

i.e. everyone made bankrupt will then have to go the full 1 year until automatic discharge - assuming discharge is not suspended for some reason - instead of the previous situation where many cases where discharged early, sometimes after only 5 months or so.

(I say many, but for the last year or so it has become uncommon regardless of the above change, but it was quite common a few years ago)

Well its one of the first occasions professionally that I've been lost for words too.

This case will now be going to Appeal and I am proud to be the Lawyer taking it on. It will be a huge mountain to climb, but already the bundle of documents is giving up useful facts.

My work won't cost the victim a single penny as I am working on it No Win No Fee; which mean if I win, the costs will be met by Lowell Portfolio. So wish us all lots of luck and a fair Judge to hear the Appeal.
"Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. For example, the pion is invariant under the restricted Lorentz group, but is an isospin triplet (meaning it transforms like a three component vector under the SU(2) isospin symmetry). Furthermore, it picks up a negative phase under parity inversion, so it transforms nontrivially under the full Lorentz group; such particles are called pseudoscalar rather than scalar. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )

That's really good news Cel..... we will all be hoping for a great success not just for you but for the poor person that has been made bankrupt and did not know the right place to get advice. Unfortunately, people will when in debt not open post or may not even know that they can fight these things and a case like this will highlight that their may well be light at the end of a long dark tunnel xxxx

Have sent e-mail to MP about this situation and made comment on subject, see what his reply will be, he has in the past tried to further events but at least it would be noted, as it is going to appeal (subjudice) no comment maybe be forthcoming but the subject matter may be looked into ?

                    Thanks Mike x

I spoke with CAB head office on Thursday re. this case and also Stormcrows case. In both instances, it is the IP fees which are so disproportionate and cruel. CAB were very aware of the problem and produced a great consultation response in 2012; but they told me there is no will within government to address the issue at all sadly. Seemingly Debt is viewed with little sympathy or concern about the ultimate cost to society.

Re: Bankruptcy - Scarier than I realised

Purely based on Gazette data for Lowell Portfolio as petitioner. (e.g. may not represent all they have done)

I have only just joined this site and find 'Alex's' story to be absolutely horrendous!! I would very much like to support, add my name, to this potential petition and concerted campaign. How do I do this?
