          You only need proof of income etc if you are applying for Fee Remission - Forms EX160a & EX160c explain this and what proof is required.

              Just to update you all went to court today with n244 been granted to stay the writ judge didnt even see me. Now have to go back for a hearing in a few weeks. What should I expect at the hearing? X

                Great stuff, m now have you sent details to Marstons & the creditor? If not do so right now, not tomorrow not next week but right now, if an EA shows up wave the stay under their nose tell him to go away as he is in contempt of court so long as you tell marstons before he shows up.

                  Did the Judge make any terms conditional on the Stay?

                  As has been said above notify Marstons preferably by email or text what has happened, you may need to provide extra details - date, Court, Judge, any terms etc. When you get the Order sent to you, again forward a copy to them - don't trust that others will have done it.

                  Dependent on what grounds it has been granted will dictate what happens at a later Hearing. See what you get from the Court first.

                    They gave me the order there and then the judge didnt even want to see me at this point. No terms given. I rang marstons they didn't ask for info but put it on my account I have emailed them with a copy of it. Attached too.

                      The individual EA may turn up claiming to know nothing that is a Marstons speciality, but if he does show him the order and close the door. The stay puts them on hold and they have no further bussiness with you at this point.

                        I have a massive problem I have court fines from the magistrates I was unaware that my payments had been stopped to them I revived the letter Wednesday of last week and I phone the next day as I didn't want it to be passed to collectors/bailiffs but when I phoned I was told I was 28 days over due on the letter it says 14.april.2014 I had treys to explain that I'd only just revived the letter the day before but there was nothing I could do my debt is only £1350.00 but iv been told I have to pay £51.56 a week. I can't afford this as myself and my partner are unemployed and also my partner only has 5 weeks left of her pregnancy I have said this to the collection agents (collectica) but the reply I get is (I DONT WANT TO HERE ABOUT YOUR LIFE IM HERE TO DO A JOB AND COLLECT MONEY I DONT WANT TO NO YOUR OTHER PROBLEMS) witch I find quit upsetting I have be diagnosed with depression and I take tablets for this what can I do someone please help I have the collectors coming to the door on the 30th of May witch they have a notice of enforcement HELP HELP HELP PLEASE...

                            starting to get very nervous about my court hearing now. Will it be just me and a judge? It say to only expect it to last 10 mins? Is that right?

                              It is a very informal affair usually in a large room where you sit round a table with the Judge at the head. You sit one side and your creditor - if they attend - sits the other side. Marstons wouldn't normally turn up. Arrive at Court in plenty of time and report to the Court Usher. Dress smartly even if casually. Be polite to the Judge at all times, men are called Sir & Ma'am for a woman. Do not interrupt them when they speak. Whatever happens good or bad thank the Judge for their time when all is done. Go over all your paperwork and make sure you understand it, take a spare copy of it all in case it is needed. It is nothing like what you see on the telly.
