  • What happens if I'm not in when the enforcement officers arrives?

    Hi,
    can anyone help please.
    What happens if I'm not home when the officers attends?
    Do they post a note through the door? Will this be in an envelope?
    Or what about if for example my sister answers the door if she's baby sitting?
    Im really worrying.

            How was it posted - 1st or 2nd class or 3rd party mail provider?
            Is the envelope franked & if so what date is on it?
            What date did you receive it?
            What date do they say you have to respond by?

              What ploddertom has asked you is extremely important, as if the dates are too short there is room for a Formal Complaint to the council, a third class post is something like TNT Post or Datapost, where it can take 3 - 5 days to deliver, so dated 1st sent 2nd or even third by TNT Post, letter arrives on the 7th day from the date, leaving no time to sort anything.

              The inference is that the Enforcement Agents are engineering an automatic Enforcement fee of £235 for themselves

              What EA company is this? If Equita or Ross & Roberts, there is every chance that the council have outsourced its revenue functions to a company called Capita, who own two Enforcement companies, Equita and Ross & Roberts........

                The letter came with normal Royal Mail 1st class it has been sent by Royal Mail. I had by the 12th of may to reply.
                I have spoken to them within this time and paid £500 and offered £150 per month but they said that isn't enough. They want £900 per month. I don't even earn that! I have now been advised by citz advance to fill in a n245 to take it back to court.
                In the mean time they are saying they haven't made an agreement. So can send an officer out. They also said I have to let them in to do a list of goods or the won't consider instalments.
                Im so scared if them just turning up.
                Also what happens if I'm not home?

                      Marstons are being disengenuous by refusing your offer if they are demanding more than your montlhy take home income, that of itself gives ground for a Formal complaint to Head of revenues, the council CEO, the elected leader (political) your local ward member and MP. The ground is they are a reasonable offer based on your circumstances. You can do that aanyway regardless of any acxion to Stay Marstons Contrary to what Marstons may claim, the new regulations don't allows them to take control of diddly squat if you don't let them in and there is no car outside for them to clamp., nor any forced entry as it is CCJ not a fine. marstons like to quote a power of forced entry under Domectic Crimes and Violence Act, but sadly for them it only applies in the case of a Magistrates Court fine, not council tax, or a CCJ so if they threaten that, include that in the Formal Complaint

                        The charge isn't for council tax it's for my grandmothers nursing home care the council pay the full amount to the home then we pay the council so much a month. Hope that makes sense? Do you think I can still do an n245 in this case? Step change charity also said I could do this?
                        Its £50 so don't want to waste money if I it won't be affective .

                          If I'm not in when they call will they post a note through?
                          Or what if for example if my sister is babysitting and she answers the door? Would they give her any information? I feel this is a very private matter. I don't want people knowing.

                            Sorry about the confusion before, but it might be worth complaining to the council via a Formal complaint as they are a public body and subjact to Human Rights Legislation, and their agents are asking for payments beyond your means but back to the matter in hand

                            If the CCJ is more than £600 there is every chance Marstons are calling as HCEO, so in that case the n245 Stay is worthwhile, how much is the debt and Judgment for, and is it a Forthwith Judgment? It might be worth applying for a variation order to the court to set payments that are affordable, but in the meantime keep marstons out, and hide any cars a good way away.

                              Hi,
                              I will do the n245 today then. It's for £9000.
                              I have also offered to pay another £1000 at the end if the month when I can get this out if my savings. So I am really making an effort and they can see this.
