    Have you sent proof of the ME to Council and EA? if not do so, it likely renders you vulnerable under the National Standasrds, I would make sure the court are also aware of this. Is your income partly or wholly benefits? Another thing Councils and EA's have ended up with egg on their faces when a court sets payments below an offer they have refused given a debtor's circumstances when deciding on a Variation Order

      Hi,
      no I haven't I did mention it to marston group over the phone and the enforcement officer today.
      Do you think I should put this on my n244?
      i manage to work most if the time I work from home a lot so that I can work when I feel well enough.
      So my income is wages.

              It would appear that you may be potentially vulnerable according to the National Standards for Enforcement Agents 2014. Proof of this should be forwarded to the Enforcement Co & Creditor, it should also form another of the grounds you are applying for a Stay on - so your N244 should be altered to this effect, this will go a long way to helping you succeed with your application.

                When you get to the Court Office you need to emphasise this an urgent application that needs to be heard ASAP, do not let them fob you off. If things go according to plan and it is granted you must notify the Enforcement Co immediately by phone - they will need some details from you, date, Court, Judge and any terms he makes. When the paperwork comes you send them a copy - don't trust others to do it for you. Keep a copy by the door to show any callers. A further Hearing may be scheduled to hear your arguments in full - but face that if & when it happens.

                    The Court system unfortunately can be a bit of a lottery, most are heard immediately but others can be left a bit in limbo. As for timescale this is a bit like how long is a piece of string, again some can be within 1 hour and others have been told to go back at 1pm or later and others have had to wait 6 weeks or more. It would be great to say go for 10am & everything will be done & dusted by 11am, it can be a bit of a lottery but by maintaining the application is urgent should get you bumped up.

                      Right ok I might ring my two closest courts then and see who I might be best going to.
                      So I go in and read my firm to them?

                        You need to be prepared to give up a whole day - if not then you may as well just post it & take your chances it will be dealt with quickly. You need 3 copies of each form, one for yourself, one for the Court & another for the Claimant (which is filed with the Court).

                          ok I'm just not sure I can get the time off if work I already had a day off last week to make phone calls etc.

                            Try your best to get the time off, Ploddertom is absolutely correct that going to the court IN Person is key if at all possible.

                                Your choice Go to work or Court if you don't take the Court route and get it sorted the Bailiff cannot be stopped hard choice we know Bailiffs care not about you or your work they want their money.
