It used to be anyone in a house caught watching the TV in a house without a license, and yes 10 and 11 year olds have been done in the past when they answered the door. TVL really is that rapacious. Many babysitters end up with a conviction also, as if they answer the door and give their name that is who the summons will be addressed to, whether they live there or not, which is why enquirer alluded to a babysitter case, the TVL goon doesn't care who is done just so long as somebody is so he can claim his commission. I think that TVL would argue that anyone at the house at the time of the visit was fair game, as they were watching the unlicensed TV in their opinion.

Do you know where you lived at that time as it is very likely to have been the local Magistrates Court.

Dolly duke, have you heard anything further,? Bluebottle is there any wriggle room for her to challenge the conviction, as she was not even a resident there? possibly even under ECHR, and HRA. Maybe a FOI to see how many non residenrts have been convicted in this wholly egregious manner, is in order.

The conviction is certainly open to challenge and I would go as far as to say the Capita Clown who called should be the one facing the attentions of Marstons, not the OP. This has hallmarks of one of Capita/TVL's questionable convictions.

The whole question of the conviction of "visitors" who answer the door to TVL in a house without a license deserves a thread of it's own, as it seems to be that a person can be convicted merely by being there, and may even have their own license at home, but TVL: will still prosecute as the license does not cover them in the property they are visiting. .

Dolly duke finfd out from the court the date of conviction, lodge a Statutory declaration as to first knew was bailiff, anmd mention that you may well be challenging the conviction as you were merely a visitor who opened the door.

                    Re: Marstons-TV licence!!

Hiya everyone sorry not been on in a while was busy dealing with this matter! After another visit from the mars ton bully boy which he turned up at my property at 6.45 am and clamped my car!! He parked at the bottom of my drive and stayed there till 1pm threatening all kinds if I did not pay the money! I had already been inconvenienced with my car being clamped I was unable to get to work and my children had to be collected for school! He was asking for £575 then he would remove the clamp from my car! I simply just didn't have that kind of money! Anyway after numerous calls to the court,I got thru to a lovely and very helpful lady, who told me if I can get to the court at 2pm I could apply for a stat deceleration,I went along not knowing what to expect,I had to stand infront of a judge and two other people swear on oath then explain my situation! my stat deceleration got granted! Nothing gave me greater pleasure in ring mr Anderton from marstons to come and remove his clamp,to which he replied he will remove the clamp but if the courts don't contact him in 24hours he WILL be back to not only clamp my car but remove it and with a locksmith!!!!! This again scared me so I spoke to the court, who said he can do no such thing,as the courts gave me a copy of the stat dec and said just show him that if he turns up at your property again!!! Am so relived this is all over!! I have never been subjected to such horrendous bullying in all my life! I felt so intimidated when he was parked at the end of my drive for hours!! Also the sheer embarrassment of my neighbours and having to explain to my children why a big yellow clamp was on our car!!!! Something needs to be done about this company!!!!!!!!'

                      Re: Marstons-TV licence!!

Whilst there are some people who work for HMCTS who are unhelpful and obnoxious, there are far more who are good, decent and honest people, as you have had the good fortune to discover, Dolly Duke.

Marstons will not be taken out of the equation whilst people stay silent, as this is taken as tacit agreement with the behaviour of Marstons' bailiffs, call centre staff and management. People have got to stand firm and refuse to be fobbed off by being told to complain to Marstons. Complaints have to be made to senior HMCTS and MoJ staff and MPs encouraged to give that disingenuous creep Grayling a hard time until contracts are torn up or not renewed. The same goes for Capita.

                        Re: Marstons-TV licence!!

Best of it is the bullying penypidyn will get nothing for sitting like a twonk in his car, all his fees are down the toilet. His behaviour and demeanour deserve a Formal Complaint to HMCS copied to MP. If Crapita now try to prosecute again, there is the defence of not being the householder and hopefully Crapita will be investigated at some stage.

I could not agree more with you bluebottle! That company are not only intimidating vulnerable adults but also young children! My children are 10 and 8 so was well aware of a man banging on our door from 6.45am!! Shouting my name thru the letterbox!! My children got picked up for school by my friend but had to go to school worried that a man in a white van who was shouting thru are letterbox was still parked across are drive! My daughter asked my friend "is my mum gonna be okay" this made me so upset knowing that she would have to spend the day in school with this on her mind!! It's infuriating!! Who would I make a complaint too about this??

Shame you didn't film him through the letterbox with a phone to capture the threats and his demeanour.

After researching clips on youtube I so wish I would have done!! I was totally naive to bailiffs and thought they can't be as bad as people say! But having witnessed it.....they really are!! And researching it more I bet the marston bully boy thought he was on a dead cert for his commission knowing I was a single parent home alone! For him to wait so long at my property!! He was using all kinds of tactics shouting thru my letterbox to speak to my parents, family members or my bank to borrow the money to pay him!! After watching clips on YouTube some of them seem to behave differently when there confronted by a man!!!!!!! Shitbags!!! (Pardon my French but they are)

I also advise anybody dealing with these bullyboys to look on YouTube! I wish I would have done this before he came! Found it highly amusing when they come across people who know there rights and are not intimidated by there bullying ways at all! And also how much they change there tactics when there being filmed!!!
