rossendale bailiffs
I have had several dealings with rossendale bailiffs. The first was 10 months ago when they were chasing me for £650+ for council tax on a property I wasn't even on the tenancy for. On this occasion as I didn't know who it was I answered the door and him and his chrony forced their way past me into my house. I called the police but as there was two of them and one of me it was a case of their word against mine as to forced entry so I was forced to borrow money to pay the full balance. I hadn't heard hide nor hair from them again until yesterday when another minion of rossendales came to my door, new address may I add, demanding 'fees' incurred from 10 months ago, totalling £197 for first and second visit apparently and van fee. I went to close the door and he stuck his foot in the way. Again I called the police as I was informed he was trespassing, just my luck the attending officer happened to be a rugby friend of the previous bailiff I had dealings with 10 months ago. He backed the bailiff up stating he had every right to place his foot within my property even though the 'warrant' the bailiff was mentioning was from march last year. As I had to leave to pick my son up from school and I didn't want to leave this low life scum bag in my house I had no choice but to pay the fees out of my rent. Can I report the bailiff? Could I get these supposed fees back? Any help would be gratefulTags: None

Re: rossendale bailiffs
Result :-D I'm receiving a refund for the supposed van and levy fee in full. Still pursuing the bailiffs conduct but at least its a step in the right direction. Goes to show they were clearly in the wrong if I'm getting a refund though so can only steengthen my complaint really

Their original levy was "the clamping incident" and, if the jalopy was only fit to be scrapped some six months later, one might question how valid or adequate that levy really was.Originally posted by singledaddy View PostThey clamped the car but no levy was made as I was forced into paying. The levy they supposedly made was about 6 months after the clamping incident and 2 months after the vehicle was scrapped
It is merely a matter of common sense that they cannot make a valid levy on a vehicle you did not own at the time and which does not even exist.

Re: rossendale bailiffs
After clamping the vehicle, did they remove it 5-7 days hence from the date of levy? If they did not, the levy would be considered abandoned. Under those circumstances, the levy would be unenforceable. They cannot claim for a levy they abandoned some 10 months ago. Tell them to go swivel.

Re: rossendale bailiffs
I have an email from the company that took my car for destruction yes :-D they had clamped that car at my previous address back in march last year so I guess they were trying to take a punt at me still having it. And 6 months had passed from the liability order and the ' levy ' being made

That's certainly interesting - how the buggery did they do that?Originally posted by singledaddy View Postthe 'levy' they made was on a car of mine but I had to scrap that car about 2 months before the levy was even made
How long had elapsed between the Liability Order being issued and the alleged levy being made?

Have you a proof of destruction or disposal that predates the levy? If so they are bolloxedOriginally posted by singledaddy View PostI've found out some interesting information. Basically the 'levy' they made was on a car of mine but I had to scrap that car about 2 months before the levy was even made meaning tosserdales have committed fraud

Re: rossendale bailiffs
Send by email initially. If the council offices are near, then by all means hand-deliver copies and GET RECEIPTS.
But don't waste time having conversations with people - unless they are recorded - and i don't think they will want that - you have no record which is what email/letters will give you. The printed word is everything in these cases.

Re: rossendale bailiffs
I would recommend you send email AND letter. If one does not arrive, the other one should. Use Recorded/Special Delivery for letters.Originally posted by singledaddy View PostThanks I have access to a computer and printer tomorrow so I will be getting it done anf sent off by Saturday morning :-) would going into the council make any difference or is it best to just make everything through letters?
