    What I'm wanting is proof of this so called levy fee and van fee. When I spoke to them earlier they mentioned about a car outside my house when I haven't got a parking space at my house. I have to park my car a couple of streets away and the car they mentioned wasn't even my car

    With reference to the above account, I would be grateful if you could provide me with a breakdown of all charges incurred.

    This includes, but is not necessarily limited to the following:


    a the time and date of any bailiff action that incurred a fee or charge.
    b the reason for the fee or charge.
    c the name(s) of the bailiff(s) that attended on each occasion a fee was charged.
    d the name(s) of the Court(s) at which the Bailiff(s) was/were Certificated.
    e the date of certification.

    f the initial balance, and any amount currently outstanding on the account

    This is not a Subject Access Request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

    Please also provide copies of any letters/documentation allegedly left by your bailiffs.

    I require this information within 14 days.

    If it is just the fees yu want then that is not classed personal information & should be demanded free. As a Subject Access Request they will have very little information on you anyway.

    Finally got my token phone call from the tosserdales complaints department. Put everything in writing which I shall be doing anyway and if I want all the documentation they have on me I have to write and request it with a ten pound fee included. Crazy they actually want more money out of me. Do you think if I went into the council as tosserdales are supposed to supply them the information that I could obtain it free. Clearly I want and need all the documentation they have but don't want to pay more money to this scum

    Oh don't worry I'm happy to stick at this, I know the likelihood of me getting my money back is slim to none but it's not just about the money its the principle as well make these low life scum realise that were not in the dark ages anymore and they can't keep getting away with this crap

    Nothing will happen overnight and you need to be in this for the long haul. Bailiffs will hope you get p1ssed off and give up.

    Remember, exhaust the council complaints procedure first, then take the matter to the Local Government Ombudsman. The law on levies has not (yet) been changed since the report I attached above.

    They may well claim a levy on a random car near your premises, then ask you to produce the V5 to prove you don't own it.Either way if they claim a levy on goods not owned by yourself, the levy is invalid, at that point you can challenge it with a Formal Complaint to the council bigwigs, CEO, Leader and MP.

    Someone should have warned you about that site.

    Sometimes their cited cases do indeed have the effect claimed, but more usually they do not and sometimes the judgement given is the exact opposite of that claimed !

    The one useful feature of that thread is the Local Government Ombudsman report on two cases in Ealing, in 1997. It was found that, for "van fees" to be charged, there must first be a valid levy in place.

    I tend to find the headband is rather chewy and the brim tends to get stuck in your teeth.
