    Re: rossendale bailiffs

I have an email from the company that took my car for destruction yes :-D they had clamped that car at my previous address back in march last year so I guess they were trying to take a punt at me still having it. And 6 months had passed from the liability order and the ' levy ' being made

After clamping the vehicle, did they remove it 5-7 days hence from the date of levy? If they did not, the levy would be considered abandoned. Under those circumstances, the levy would be unenforceable. They cannot claim for a levy they abandoned some 10 months ago. Tell them to go swivel.

They clamped the car but no levy was made as I was forced into paying. The levy they supposedly made was about 6 months after the clamping incident and 2 months after the vehicle was scrapped

Their original levy was "the clamping incident" and, if the jalopy was only fit to be scrapped some six months later, one might question how valid or adequate that levy really was.

It is merely a matter of common sense that they cannot make a valid levy on a vehicle you did not own at the time and which does not even exist.

Result :-D I'm receiving a refund for the supposed van and levy fee in full. Still pursuing the bailiffs conduct but at least its a step in the right direction. Goes to show they were clearly in the wrong if I'm getting a refund though so can only steengthen my complaint really
