    It will be interesting to see how they respond to a request under Section 35(2), Data Protection Act 1998. To the best of my knowledge and belief, they cannot demand a fee for disclosure requests under Section 35(2). They can if the request is a Subject Access Request under Section 7 of the Act.

            Unfortunately I paid the charges already as I was forced to but surely it proves they had no legal right to demand these fees and use the council tax warrant as an excuse

              Exactly.

              As they are ostensibly working for or on behalf of the council, the council is responsible for their conduct. You should seek the documentation from Tosserdales, but seek reimbursement of the excessive fees from the council.

                singledaddy - send the email wording i gave you earlier to rossendales. when you get a reply, check the fees, come back here for more advice if necessary/checking for overcharging and then send that and your dvds to the council people, headed formal complaint.

                do not waste your time phoning.

                on NO account believe other sites which will encourage you to submit a form 4 complaint - which could cost you thousands!

                  Thanks I have access to a computer and printer tomorrow so I will be getting it done anf sent off by Saturday morning :-) would going into the council make any difference or is it best to just make everything through letters?

                    I would recommend you send email AND letter. If one does not arrive, the other one should. Use Recorded/Special Delivery for letters.

                      Send by email initially. If the council offices are near, then by all means hand-deliver copies and GET RECEIPTS.

                      But don't waste time having conversations with people - unless they are recorded - and i don't think they will want that - you have no record which is what email/letters will give you. The printed word is everything in these cases.

                        Just keeping you updated I've received no response from anyone as yet but I only sent letters and emails this week so we shall see. Wanted to post just to keep everyone updated on this. Thanks to anyone who assisted me with this I am very grateful

                          I've found out some interesting information. Basically the 'levy' they made was on a car of mine but I had to scrap that car about 2 months before the levy was even made meaning tosserdales have committed fraud

                                How long had elapsed between the Liability Order being issued and the alleged levy being made?
