    Hi. Im new here and in need of help asap if possible.
    I received a letter from rossendale bailiffs regarding un paid council tax the debt of the council tax was £300.73p
    Ive since had charges added £95. authority costs
    Visit fee £24.50
    Visit fee £18.00
    levy fee £39.00
    Walking possession £12.00
    Schedule 5 fee £24.50
    van attendance fee £160.00
    Can they really charge this amount? Im only reciving maternity pay at the moment so am struggling as it is without some bailiffs doubling my debt helpppp

    First of all, read the notes on Council Tax problems - link - and then please answer a few questions:

    1. Which Council is involved?
    2. How many times did the bugger actually visit your home?
    3. Did you let the bugger in?
    4. On what goods did the bugger levy distress?

      Has the baby been born or are you still pregnant, you may well be vulnerable either way under the National Standards which makes bailiff action inappropriate

        I did very stupidly allow him in once
        He levyed on my mobile phone and a very old laptop

          No ive had my baby now I live with my partner in his house everythinh is his and im worried they'll try take his stuff or break in to his house :'(

            What make mobile phone did he levy, and how old is the laptop? It may well be the levy is insufficient to cover the debt and fees if the items were sold Did he list the mobile phone exactly, including the IMEI number? if not he may be stuffed.

              Its a samsung galaxy s3 cant honestly remember if he took the imei number. But I do remember he noted it was an insufficient levy laptop is very old bought second hand about 5 yrs ago

                Is this a council tax debt from before you moved in with your partner? If so the bailiff cannot touch anything of theirs.

                      Probably inadequate and hence invalid or improper.

                      Levy fee = £24.50 + (338.23 x 0.04) = £38.03 and, when rounded up - £39!
                      This rounding up may be permitted by law, but one must surely wonder why...

                      The Schedule H fee is only applicable if the levy has been paid off.

                      The van/attendance fee seems hardly appropriate, given that the only two items levied upon are so readily portable.

                      However, one must doubt if the items levied - a mobile telephone and an old laptop - would realise enough at auction even to pay the bailiff's and the auctioneer's charges and fees, let alone pay anything to the debt owed. The levy would then be insufficient and therefore improper - it was done to garner a fee which, as you'll have seen, was miscalculated.

                        Nor may they seize any of his goods in settlement of the debt, and nor are they allowed to snatch your child to sell to some pop singer.

                          I've paid off £330 I just dont want them Turing up at my house and my partner been home he'll kill me! Ive spoken to council there not willing to do anything bailiff is demaning full payment I obviously don't have this amount of money and i certainly don't want to pay excessive charges.

                            If he didn't, he's more stupid than usual; you could get a broken 'phone of the same model on eBay for a few quid and give him that. But don't give him the charger, though, as he didn't list that.

                            If he admitted anywhere in writing that the levy was insufficient, then he's utterly stuffed.

                              I'd say that this bailiff is on borrowed time, he has stuffed himself most royally, the £160 van fee is not kosher as per CC, and he has put insufficient levy. I wonder if the numpty thought that writing that gave him the option to return and snatch more goods later, if so he is more deluded and stupid than we first thought.
