That, I suspect, is because you are dealing with the mindless and heartless morons in the council call centre. You should contact the Head of Revenues (or whatever title the berk has) at the Council, explain that the baboon from Rossendales has overcharged and tell him/her/it that the actions of the bailiff - for whom the council is ultimately responsible - is making it difficult if not downright impossible to pay the debt. Remind him/her/it that a mother with a very young infant is considered "vulnerable" and that, on learning of your circumstances, the bailiff should have withdrawn at once if the National Guidelines meant anything more to him than a free source of toilet paper.

You will doubtless get some silly flim-flam in reply; if you do, you can escalate the complaint to the Chief Executive of the Council. If even he insists on playing at Silly Buggers, there is still the Local Government Ombudsman to whom you can complain.

Whilst you are complaining to the council officers, you should also tell your elected councillors know about this; after all, they get paid enough and all they do most of the time is to spread their ample arses on the council chamber benches or occasionally thrutch about, wearing out the leather upholstery. Find out who your councillors are here - link - and also contact the leader of the council and the leader of the opposition party, so the matter is less likely to be conveniently ignored.

Children can be like that.

Can you photograph or scan the Form 7 (Notice of Seizure) left by the bästärd bailiff, edit the image to remove your personal details, upload the image to http://postimage.org/ and post the link here?

I'd very much like to see what he wrote down.

Another thing - do you know his name?

One of my principal concerns is what the bailiff said or did in order to gain entry to your home. It is important that you advise us exactly what the bailiff said and did in order to make you let them into your home as this may have a bearing on the validity and legality of their fees.

Did the bailiff say he "Had a Right" to come in, could come back with a locksmith" or any other veiled threat of forced entry?

A stroke I've noticed bailiffs have been pulling lately, BB, is "I have gain entry and levy in order to set up a payment plan". Total BS and totally illegal. It is deceitful conduct intended purely to garner fees and gain a financial advantage. It is also likely to invalidate any levy they might gain.

Problem is it is debtors word against bailiff when bailiff says I was invited in. Another reason to either film them or use the sound recording facility on many MP3 players

Oh they do this long before they attend, usually, when debtors try to set up a payment plan over the phone. The other point to make is that if after a bailiff has gained entry by coercion or deceit, it becomes evident to the debtor the bailiff has gained irregular entry or their purpose is not to use the phone, etc., they are entitled to ask them to leave and, if they will not leave, to use as much reasonable force as is necessary to effect their removal. There have been cases where bailiffs have illegally forced entry and then lied to police they were invited in or "gained peaceable entry". The two muppets in R -v- Tucker tried this one and HHJ Brown would have none of it. Your advice to film, if at all possible, BB, is sound advice and action I would advocate and endorse also.

                  Thankyou for replying :-)
If the phone (not the SIM card) and the laptop contain any information stored on them that is subject to the Data Protection Act the levy is unlawful

Unfortunately he has gained entry and now he can regain entry at any time, even using a locksmith without the need to apply to any Court.

The only thing you can do now is ask for a full breakdown of the fees and compare them to the National Standard, and if they are wrong then fight them.
The Black rat (Rattus rattus) is a common (hence the accusation of being Pleb) long-tailed rodent of the genus Rattus (rats) in the subfamily Murinae (murine rodents). The species originated in tropical Asia and spread through the Near East in Roman times (another thing that we ought to thanks the Romans for, besides roads, aqueducts and public toilets) before reaching Europe by the 1st century and spreading with Europeans across the world.

A mutation of the beast now comes black leather clad, riding a motorcycle that looks like a battenbergh cake on wheels.

A skilled predator, totally ruthless with it's prey, but also known to be extremely generous in doling out tickes that can provide points for motorists who want to downsize from mechanically propelled vehicles to bycicles.

It's a dirty job, but someone got to do it!

If you read the thread properly, you will see that the bästärd bailiff gained entry to the OP's dwelling when she was living alone and that she has since moved in to her boyfriend's home to which the aforesaid oaf has not been admitted.

Do you consider it is reasonable to charge £160 for a van to remove a laptop computer and a mobile telephone?

Did he say that you had to let him in so he could arrange a repayment plan and could not do so if you did not let him in?

If it is your BF's house and the debt predates you moving in together he cannot have any of the goods that were vbought by BF prior to that, if he has written Insufficient Goods on the notice also he is knackered. BF needs to do a Stat Dec stating ownership and bailiff can foxtrot oscar on the daisies.

Another issue that makes councils eager to use bailiffs is that some demand a kickback from the fees say 8% which amounts to unlawful garnering of revenue, something else for the DPP and courts to stomp on, except they won't as it will bring the whole council tax enforcement regime into disrepute. As if it can be more disreputable than it already is.
