    Thats why we didnt expect him to be serious about pursuing us and would drop it as he evicted us illegally. thanks plan B

      Been going round in circles for weeks. cant get cit advice help till sept 10th and seemed we didnt get good advice from court office for original stay. Think with the stay we should have put in variation order but who tells you this. If you think my threads are everywhere its because every waiting minute is searching for advice . not much time to work out this site. One thing i know is that there is no advice for this and citizens advice is booked till well into september. There may be one source of help and ill get back to you if it works.

          My input is on a possible illegal eviction which would give rise to a possible disputed repossession order which would give rise to a possible *question mark* over whether this debt should be collected by these bailiffs :doh:

              Let's keep it on here as said. Plan B will look at the housing angle, what do you want from us in terms of bailiff help? Hopefully you'll find us every bit as good, and possibly better than CAB. Legal Beagles is definitely one source of help, and we'll go out of our way to help you if we can.

                Can you appeal an appeal against a CCJ which was refused?Would it be the case here that any action to pursue an illegal eviction would not stop this CCJ being enforced and HCEO fees having to be paid? I have a feeling that any action taken now by the OP will be regarded by a court as trying to avoid paying>anyone have any info case history or thoughts on that. I cannot see how the OP can avoid the CCJ and fees wish there was a sure way

                  Do you mean has the OP already applied for a set aside of a CCJ for rent arrears which was refused :confused2: or was there a possession order granted with a money judgement for any rent arrears combined and no application has been made for a set aside of that order? :confused2: Two very different legal avenues.

                      In the first post the OP says they applied for a stay paying £80 which was refused is that the same as an appeal or do you keep paying to get it stayed or dismissed?Or am I reading this all wrong

                        Given that there are so many one line (or shorter) replies it has taken me 25 minutes just to read this thread !!!

                        Once a writ of fi fa has been issued, you need to make TWO applications to the court. One is a Stay of Execution on an N244 and the other application is to "vary" the payment terms. Once judgment has been entered, payment of the amount due must be made "forthwith" (immediately). If this cannot be afforded, then everyone subject to a judgment MUST complete an N245 to "vary" the terms of payment. In your particular case, you merely applied to "stay" and I assumed that you also applied to set aside the judgement. Sadly, you did not apply to vary the payment amount to an affordable monthly payment.

                        In one post you have given details of "frankly" huge enforcement fees and then you have stated that the the fees have been drastically reduced from approx £2,500 to around £950. You have not explained the reason why such a drastic reduction was made. Could you please explain.

                        Next....on the Form 55 (Seizure Form) can you please provide details of any items that have been listed on the form ( in particular, is there any mention at all that a car has been levied upon). This question is very important.

                        With regards to the car....how much roughly is it worth and is there any finance against the car?

                        Next.....would you mind posting back with details of which enforcement company this is.

                                The only winner where bad advice is given unfortunately is the bailiff.
