    If the debt was for a previous occupant, or the wrong J Smith due to a faulty trace, if the debt is owed then facing up to it and dealing with the situation with help from Beagles is a good option:beagle:

      Hi and welcome to Legal Beagles. What sort of debt was the HCEO chasing, and what was on the form, did it list your car, or was it global, as in I have seized all goods and chattels belonging to the debtor?

        I would think that as you did not pay the claimant after the judgement and the HCEO was then involved you will have to pay the fees worth checking they are correct and to find out if you can have the fees checked , I cannot see that you can avoid the fees they are only a charged to you because you failed to pay sorry to say

          I would begin by scrutinising the writ for any irregularities which might void it.

              Hceo refusing our payment offers

              Weve offered £50 per month to pay judgement debt of £1300 .HCEO wants double. HE has reduced his charges to £996 from £2500. Should we be grateful for one visit and a 55 put through door. He wants our car and is blaming creditr for not accepting though we agreed £50 with creditor till sheriff persuaded him otherwise. Our stay failed as we hadnt told a new address to court because we thought it had been dropped. We would like to try a n245 but cant get any help with this till 10th september . Would it be accepted this time. We used a n244 last time. Are some courts better at this than others and can anyone advise how to fill in n244

                  Stay failed so bailiff back

                  Had a nasty experience at court where judge said he didnt like our behaviour (not giving a forwarding address because creditor took so long itemising his claims that we asked for we thought hed dropped it). Hubby had heart attack and we had to move as well so were distracted. Landlord illegally evicted us too so cant believe hes pursued us. The stay wasnt allowed so he told us to make arrangements to pay after. This threw us at mercy of creditor who tried to run off without agreement telling us to see his sheriff. He then shook hands and agreed £50 per month. However later we received an email saying the sheriff didnt want him to accept payment. Now they are asking £100 per month and both blaming each other for not accepting offer. The charge of sheriff was £2500 for pushing 55 through door . They reduced itto £996 which puts the debt at £2500 including £1300 judgement debt.This would mean paying £100 per month for a number of years which is unaffordable for us just for their fees. We will pay debtor but the fees are just outrageous and surely fraudulant. Noone will let us pay what we can afford. To be honest ill never trust a court again because he didnt like our behaviour (after being illegally evicted but hes thrown us to the lions (croydon bailiffs) who are fraudsters-thats British justice. Judge Rodgers ,crewe.
                  How do we pay and are some courts better than others .Worried the n245 will be turned down. Then how do we pay?

                    The fees appear to be Legal so would expect that you would have to pay them sorry to say if you had given your new address and paid the judgement the fees would not be there I agree the fess are steep but if they are legit not a lot you can do I know you may like this but that's how it looks

                        As I said before if the fees are legit whatever we think about them matters for nothing you said you didn't know he took you to court was that because you did not give your new address i am no legal mind but sorry to say your there is no way out unless maybe there is some sort of appeal ?

                              Also cant pay till you know and then should be given a chance to pay. Another question, how did a landlord acting illegally and locking us out get away with this

                                I think you can check the fees out on the HCEO website if they are not legal quite obvious you don't have to pay check it out
