    I totally agree with you, PT. DVLA have done this a bit too often. Capita/TV Licensing, too. The other thing to remember with magistrates courts is that the forms used there are completely different to those used in the civil courts.

          Thanks for the correction over the N244 - a stupid mistake.

          My take on the rest stands though. The OP moved house and apparently did not make any arrangements for the mail to be forwarded. Unsurprisingly communications from the DVLA would have been sent to the old address and the OP would never received them. As it is, the DVLA yet again claim not to have received them, thus the fine notification was sent to the wrong address.

          This would have been very easily resolved at the time without any need for it to be escalated like this - Perverting the Course of Justice is, in my opinion, going way too far.

            The offence is committed, but the probability of prosecution of those responsible whilst a corrupt government is in office is remote. However, stranger things have happened and I do know that the 95% of serving police officers who are honest and sick to the back teeth of what is going on are forging ahead with some very major investigations, despite attempts to stop them, and a number of people in very high places are not only panicking, but absolutely crapping themselves, also, because it will only be a matter of time before they get a knock on the door - or should that be a battering ram or chainsaw through the door - at 6.00 am in the morning and a load of hairy-arsed coppers stomping all over their homes asking them some very awkward questions.

                        Do you mean Monday? Today is Friday. The only hearings on Saturdays are charge courts and, then, only in the London area, some metropolitan boroughs and some of the larger provincial cities.

                            Thank you for all the advice,
                            I will do a stautory declaration on monday and I can do it at my local court. I have the template and have filled it out it isnt exactly difficult.

                            I did have mail forwarding for 3 months and did not receive any forward mail from DVLA The forwarding ceased exactly on 3 months the post office didnt give any leeway but by then I had told every one that needed to know, changed my driving licence details which are on the V5s too I find it incomprehensible that the DVLA cant match 2 databases

                            I will keep you posted.

                            Incidentally I have just received a Sorn renewal notice from DVLA for a car I scrapped 18 months ago at an official recycle unit. I telephoned them pointing out their mistake and was told nothing they can do over the phone have to put it all in writing in the meantime I am liable until its sorted. I cant SORN it legally as its fraud as I dont own the vehicle but by sorning it i have 12 months for them to get it sorted they dont exactly help you abide by the rules do they

                              Did the Approved Treatment Facility (ATF) issue you with a Certificate of Destruction for the car you scrapped?

                                I received a fine for this same offence about two years ago. I wrote a letter to DVLA saying I had notified them, asking them to look back through my history of car ownership to see if I'd ever failed to notify them - they waived the fine.

                                It is a very common occurrence and I'm sure you'd have challenged it appropriately in a timely fashion had you had the chance.
