    Well this is what contacting my Councillor did for me.

    "Hi Dave.
    I have spoken to our debt management team and even if we did take the debt back we would still owe rosindales the collection debt to their account.If you come in and speak to us or the CAB we may be able to negotiate payments on your behalf. I would recommend your first port of call to be the CAB. They have special relations with rosendales and have free debt specialists. TiaCllr Darren Billard"

    On the plus side the bailiffs haven't been back since I told them I have an appointment with a CAB adviser on Monday

      You would certainly owe Rossendales any legitimate fees they have charged.You only sent the letter asking for a breakdown 2 days ago, so I would wait until that comes back, post fees up here and then negotiate a payment plan through the council ensuring only legitimate fess are paid to the bailiff. It might even be worth paying the council the bailiff fees first - asking for it in writing that the fees are cleared and then negotiate the repayment plan.

        I received a posted letter (stamp on delivered by postman) dated 13/06/13 with no time on it.

        BAILIFF REMOVAL in big letters

        Balance in full £540.96

        The letter also says they have attended today which they havent, there are x3 Giro payment slips of £180 per month dated 30/6, 30/7 and 30/8.

          Go to your CAB on Monday, and ensure they do a financial statement for you. This will show how much you can afford. Don't agree to any repayment you know you will struggle to stick to.

            Yeah thats what intend to do, at least I'm assuming they wont visit again until after the 30th as the letter doesnt say anything about calling to accept the payments so to me that says they will await my payment on the 30th before they act again.

            I havent received a breakdown of the fees as yet but their new demand is less than the £601.

            My issue is with the council as the period they are claiming this £390 from I was claiming JSA and HB.....so surely that exempts me from CT?

                OK I have re-read my Notice Of Distress and I have realised that Rossendales have charged me £130 for Walking Possession.

                So the charges so far:

                Client Debt = 390.56
                1st/2nd Visit = 42.80
                Levy Fee = 38.00
                Walking Possession = 130.00
                Total = 601.56

                I requested a breakdown and they responded with a new figure of £540.96 and request of 3 monthly payments but no break down of the fees, so they have removed £60.60 but not told me why.

                Shows walking possession fee as £12 (correct?)

                So with that in mind Rossendales are still up £48.60.

                Should I hit my Councillor/Council with 4. COUNCIL TAX LETTER TO THE HEAD OF REVENUES ?

                  Yes, send them that. Make sure you send the version there now, as it has been edited just a few minutes ago to reflect government guidance which only came out yesterday.

                  Send it to the Head of Revenues at your local council, and I would be inclined to copy it to your councillor as well for information.

                    The council rang to tell me they had had a email from my Councillor and could they have my permission to discuss my claims and such with him, I said yes and they said they would now email the Councillor back and confirm.

                    The plot thickens

                    Might be a good idea to hold off on Letter 4 till my Councillor replies tomorrow?

                      Don't hesitate to let the Councillor know you know of the new guidance as they almost certainly won't, and the council may well not.

                          Wonder whether marstondales will be the first bailiff co to claim that the as this enforcement commenced pre new guidelines, they don't apply in this partuicular case?

                          When the councillotr contacts you, have the guidelines at hand and how they apply to your case, also appraise them of the LGO findings in Blaby Council & ROSSENDALES, if he spouts out the line fed him by Revenues.

                            Where can I get a copy of the new guidelines?

                            Received this email from my Councillor after questioning the dodgy fees and their legal ramifications.

                            "Hi Dave.
                            I need to re iterate the best route to solving problems with spurious charges from rosendales is to meet with the cab or our officers. I am happy to attend with you however I have just had the final report back and we have a 6 month cap on back dating claims. This means we would no longer be able to back date your claim as it is outside that limit.Darren."
