    They CAN backdate CTB if there has been an error, but would rather not

        No branding on my car.

        Well Ive been to the Council as they had sent me a court order to pay this years CT too!

        They checked the system and found that I have given them evidence to support exemption until 2015 due to studying a degree, this is now cleared up and they have zero'd that debt.

        I asked if they could take back the debt from the bailiffs and the said no.

        I have sent Request Letter 1 to Rossendales and will be getting a Statutory Declaration for my car sorted and posted tomorrow.

        Council lady said I should go see Citizens Adive about Rossendales so that where Im going no.

          Please look at Article 70 (link) of the celebrated Local Authorities (Contracting Out of Tax Billing, Collection and Enforcement Functions) Order 1996 and you'll see that the council does have the power to stop enforcement action.

          I ... will be getting a Statutory Declaration for my car sorted and posted tomorrow.

          I wonder if that will do any good, as they might decide to take it anyway - that was why I asked about branding.

          Does a neighbour have a garage in which it could be locked away when not being used to make fat people grow fatter?

          Council lady said I should go see Citizens Advice about Rossendales so that where I'm going now.
          Please tell us if their advice is significantly different apart, that is, from not containing any Latin. :grin:

            The situation with your car is relatively simple. Is the vehicle insured for business purposes and are you the sole driver under the policy. If the vehicle was seized and removed and claim for tools of trade will be overruled as it is akin to a salesman carrying samples - they could be conveyed in a different manner by public transport or taxi. Now if the pizza was the size & weight of a blacksmiths anvil for example then that is a different matter.

              CAB advice will be to comply & pay the Bailiff. I say this because CAB although they do a good job in some areas are very hit & miss when it comes to Bailiffs. There is more information in the stickies in this Forum than most CAB offices know.

                I rang Rossendales about my car and they said it would be classed as "tools of the trade" and I need to prove the with a letter from my employer.

                  The councils excuse to not take the debt back was that Rossendales have added £200 on costs to the debt.

                    The main issue for me is I live with my partner, son (16) and daughter (10) and we are now holed up in our house and forced to hide our car streets away!!

                    We are scared to leave the house and dont have £600 or really want to pay £600 for a £390 debt i wasnt entitled to pay but didnt realise until it was too late I shouldve claim for......If they take my car I will loose my job.

                    This country is a joke.

                      I can sense your frustration, but you must act. Have you sent the letter linked from post 5 yet? If not, get it in the post first thing in the morning and get at minimum proof of postage, you may want to use recorded delivery.

                      The council can take the debt back. It is a simple as that - they are lying to you. I would contact your Councillor (any time 8:30am - 9:00pm is reasonable) and ask if s/he will go with you to the Council Offices. If they refuse, ask them to sign stating they are refusing.

                      As for your car, don't believe the bailiffs. There is no reason why your car would count as a tool of the trade as far as the bailiffs are concerned. In all probability, you were told that so you felt safe to leave your car outside to give them an easy levy.

                      Do you have Class 1 business insurance for delivering the pizzas?

                        Im insured by Dominos when Im clocked in but any other time its used under my personal insurance.

                        I sent the letter number 1 to ask for a breakdown of the fees to Rossendales today.

                          I have written this email to my councillor is it OK?

                          "Dear Mr Billard

                          I have been contacted by Rossendales bailiffs on behalf of the NE Lincs council to recover £390 outstanding council tax fees.

                          I contacted the bailiff and offered to make reasonable payments they flat out refused these and have added further fees totally so far £601 (£130 of this is not shown on their letter of distress and I have wrote a letter to Rossendales to give me a full breakdown of their fees).

                          I do not have £601 to pay out right so they are threatening to remove my car as for of levy, I'm employed as a delivery driver and the car is used for this job so you can understand this is causing distress to myself and family.

                          I live with my partner and two children and we are scared and frustrated that we can be treat in such a manner.

                          I have asked the council to take the debt back so I can pay it direct to them with out the distress caused by the bailiff, they have told me they can not do this.

                          I have been advised that this is not the case and the law states they can take the debt back.

                          I have been advised to contact on this matter and to ask you to accompany me to the council offices to request that this debt is taken back so I can pay the amount as quickly as possible.

                          I await your reply.

                            My Ward Councillor replied this morning and said he would have "meeting with the relevant officers and get back to you."

                            So fingers crossed!
