        Has the Bailiff's name been checked against the Register? One of them appears to be missing & for the other there appears to be a choice of 5 although only 2 of which are given as Marston Group.

          How about their wheeze where a fine defaulter has moved, so they claim the Mickey Mouse MS Word warrant they concoct is to the address so the new occupier must pay or they will be arrested. that would be more indicative of the type of stunt they pull.

          Marstons should be wound up forthwith.

            The worst that can happen to Marstons, as far as their HMCTS contract is concerned, is that they could lose the contract altogether. The Mickey Mouse "Distress Warrants" they produce to fine defaulters are, IMHO, as previously stated, not worth the paper they are printed on. There is nothing to prevent Marstons printing out a sheet detailing their charges in connection with their HMCTS contract, that is perfectly legitimate and a requirement under the terms of their contract with HMCTS, but placing the words "Distress Warrant" on that document is, IMO, potentially illegal and, potentially, an offence under the Forgery and Counterfeiting Act of Using A False Instrument With Intent to Deceive, as well as a potential offence under Section 2 and 6, Fraud Act 2006, that is, Fraud by False Misrepresentation and Being In Possession of An Article for Use In Connection With Fraud.

            My thoughts on Marstons senior management is that they need to wise up to the conduct of their directly-employed and contracted bailiffs PDQ and the consequences of their actions, not only for the bailiffs themselves, but the company and its management team also.

              I seriously doubt that they are unaware of the systematic abuses and of the jack-boot ethos in which the abuses proliferate.

                  If that is, indeed, the case, CC, it is going to come as an awful shock to them that the actions of their employees are illegal and that they, the senior management, can be held to account by the courts and go to prison for it. Whether such behaviour occurs with their consent or connivance, they are stuffed, legally, and can be trussed and roasted, legally, by the courts.

                      Connivance is what catches most company management teams. Turning a blind eye to wrongdoing is just as bad as knowing it is going on and either actively encouraging it or taking part in it, as Jamie Waller, MD of JBW, does from time to time (video available on internet).

                        Surely in a case like this the 'victim' would be within his rights to remove the illegally placed clamp and failing that bill Marstons for taxi fare everywhere he has to go. If I came out and found my car unlawfully clamped Im afraid the nearest baliff would be wearing it as a necklace

                          I don't know if you've seen the "Clive's Cats" series of souvenirs, ODC, which feature a triangular-shaped cat with humorous captions like "Don't be boring, wave at a nutter!" under the picture of the cat, which I believe is called Barry. Insert a wheelclamp into a certain bodily orifice at the lowermost point of the bailiff's alimentary canal and he would end up looking like Barry. You could then take a photo and add the caption, "Never p*ss-off a debtor."

                            I wish I had been braver at the time... however his threats to "get the boys round" to remove the car and incur extra costs had me terrified. Still trying to get through to the court... sigh....

                              No joy getting through to the court today Does anone know whether there is an email address, or anyhere I can write to? I am not letting them away with this!! the have left my family without food, and I wont stop until I get my money back! Also does it make a ifference that the baliff dealt with me without knowing who I was even though the fine was in my husbands name!
