    Bad enough then to report Crapquita to HSE for failure to carry out risk assessment into the effect of their enforcement and clamping on your vulnerable family, do it tomorrow, i think bluebottle can provide the references to what sections of the HASWA 1974 to quote that they have breached. Oh and refer the council to the HSE under the same head, as they areultimately responsible for Crapquita, and if someone died as a result of Crapquita the CEO would be in the dock with them if Corporate manslaughter was alleged

      I have a friend who has had Crohn's for some years and had a couple of close encounters with The Grim Reaper through it. I am not attempting to frighten anyone, just illustrate how serious Crohn's can be.

      From what you have said, Jedi, I would say you have grounds to lay a complaint of Endangerment to Health under Section 3, Health & Safety at Work Act 1974, which lays a statutory duty on employers not to endanger the health and safety of members of the public as a result of their operations. The fact that the car does not belong to the debtor, making the clamping illegal, compounds this. I would contact HSE first thing tomorrow morning and seek advice and guidance from them. I would also consider getting his GP to write a letter, copies of which can be handed to the creditor and bailiff company.

        13 hours later they return my call, got it on voice recorder he said he hasnt clamped the vehicle illegally whatever was his reply he will get someone round within the hour so long as i have proof ie log book and insurance which i had last night, i have the money so once this is out the way i can get to a law centre along with photographic evidence a video of today and all letters and wrongfull Clamp notice and see how we get on

          It was illegal clamping from the moment he was informed car belonged to a third oparty, the fact it remained clamped for so long compounds the guilt. Get that report in to HSE.

            Yes thankyou will do once he has been round to take the clamp off ( will see how long it takes him ) then i will pay him and get to the law centre to sort this mess out

                  The money is owed to the council, not to the bailiff.

                  Didn't the bailiff already know that the vehicle did not belong to you?

                  If he did, then he had no right to seize it - and certainly had no right whatever to clamp it.

                          They are obstructing my BF from moving his car we need it for Drs appointments for both himself and my son, I dont need thiss stress its doin my head in i can get him out of the way, and then fight afterwards

                            You will have giving in to this moron who illegally clamped the car,can i clamp the car tommorrow and you pay me to remove the clamp its the same i would be doing it illegally same as he has get it removed then tell it to leave and you will pay the council if he tries to reclamp the car call the police they have to act

                              Is that the only reason you have decided to pay the bugger?

                              Remember - bailiffs take their fees first, so if he's invented any fees (which is almost certain) he'll be back again in a week or two.
