        We have managed to borrow £500 from most of the family, should we pay the bailiff as he has requested it tomorrow or do we hold off !

            JBW are in breach of their OFT Licence by letting their bailiffs tell you to borrow money to pay a debt. Loss of that licence would mean them losing public debt contracts, which often stipulate a contractor must hold a valid and current OFT Category F Debt Collection Licence as a condition of contract/tender.

              Magpie, use the above to ground a complaint with OFT for breach of Category F licence, you could also let the council know that JBW are telling you as a vulnerable debtor to take on MORE debt merely to pay them, and copy to MP.

                I am going back over the details of the levy to give Magpie some facts to tell his elected local councillor when he gets round to taking up the matter with them. I am sure the elected councillors would like to know and should be told how local taxpayers are effectively being swindled by the bailiffs the council uses.

                Whilst the levy fees for each liability order would be correct if levied separately, the levy fee for a combined debt of £2412.19 would be ((1912.91*0.025) + 16 + 24.50) = 88.33, rounded up to £89 rather than the £118 this bailiff thinks he should get. Likewise, there should only be one walking possession fee.

                The visit fee would be correct for a first visit, but it is wrong to charge both a visit fee and a levy fee for the same visit. It is at best questionable for two visit fees to be charged for the same visit.

                redemption of goods fee £24.50
                attendance to removal fee £180
                Neither of those is applicable.

                So, the spurious fees added are 2*24.50 + 12 + (118 - 89) + 24.50 + 180 = £294.50

                balance £2808.41

                he said the minimum he can except is £500 on Thursday
                As the fees claimed total £395.50, the council would only get £104.50 rather than £399 which they should have received if the bailiff had not bumped up his fees.

                    I've looked through the thread again, but that detail still eludes me. Can you tell me in which post it was mentioned?

                    One might certainly wonder how the bailiff expected his victims to raise the money. Did he suppose they might sell their youngest sprog to Madonna, even though it won't match Madge's colour scheme?

                      Absolutely, bb.

                      Magpie, in your letter, emphasise to the local authority that what Bull & $h*t are engaged in is a breach of OFT rules and regulations and that you will be obliged to implicate the local authority in any complaint to OFT Credit Fitness Team for failing to adequately and properly supervise their contractor and failing to ensure their contractor is complying with the law, generally. Expect them to deny B & S are doing anything wrong, but that would hang the local authority as well as B & S.

                          Also thanks CC as confused as BB, whoever Bullys & stupid are out of order suggesting a vulnerable debtor borrows more increasing their overall indebtedness merely to pay them. They deserve both barrels from a trusty Purdey filled with rock salt, or the contents of a chamber pot from an upstairs window.

                              No very true it is sacrilege, but if one used a Baikal it wouldn't last beyond the first barrel, whereas the Purdey would likely survive. Don't know about the seat of the bailiffs pants though!
