Chief Constable, in the first instance, CC, but I have a gut-feeling this complicity is systemic. Therefore, a complaint to IPCC with a copy to the Home Secretary is in order. Kim you have been dealt with unfairly, as due to your circumstances, and work patterns you have been prevented from working and taking children to school, a bailiff will argue that a car is not essential, as public transport can be used, in your case not possible so that argument is invalid, the car is not worth enough, to cover all fees and a sizeable portion of the debt, again bailiff has levied and persuaded the police to effectively steal the car for him, solely for fees.Originally posted by kim481 View PostBluebottle,

I feel that marstins will have an ephiphany over this one when they see the hole they have dug for themselves. Sadly the police who should have felt the bailiffs collar, have probably broken the leaw themselves by aiding and abetting him. They are as inept as Clouseau, which is why i spelled Law as Leaw.
Might be worth reiterating the fact marstons have ignored totally a potential vulnerability

All of my family and friends work within school times. I'm worried that when I can't get my kids to school I will then be in trouble for that too

Yes I am happy for it to be referred to the relevant people. I just want this whole mess over with. I feel I have been treated unfairly and am so upset over this. I haven't got a clue how I'm gonna get my kids for school and how I am gonna work tomorrow.

By taking the car, they have prevented Kim from working, therefore made discharge of the debt almost impossible, surely that isn't justice, marstons and police hang your heads in shame, is this not an action likely to breach Article 3 of the European Convention on Human Rights as it is Cruel and Inhumane Treatment, tantamount to torture? And way beyond any original fine or sentence in it's impact? Which also then brings in Articles 4, as the enforcement is effectively a sentence without a proper hearing, and 8 where the right to a family life is impinged due to effect on children, .

I am currently waiting for the Bailiff Working Group members to get back to me. Would you be willing for this to be referred to the CEO of Marstons and/or one of the Heads of Enforcement Operations at HM Courts & Tribunals Service, if this becomes necessary?

Also the police woman agreed that I do in fact need my car for work. She has now suggested as I am not able to go to work as I have no car to look for a job in a residential home!!
