    Re: scared of bailiffs

    Samwiggy,

I know this is scary for you. I've been in the position of having bailiffs on my back for four liability orders, so I know just how scary it is. Please trust us. Don't e-mail the council, don't open the door to the bailiff or speak to him. Just make sure your car is parked a couple of streets away so that he cannot levy on it. There is absolutely nothing the bailiff can do.

He may be entitled to charge for two visits (£42.50 in England) but that is all, as long as you make sure he cannot get in to levy. The Council Tax link gives the advice you need about locking doors, keeping downstairs windows shut and moving your car. Once that is done, just pay as much as you can afford, regular as clockwork, same day every week, using the telephone automated service or online. Ignore everything else for the moment.

    Is that OK?

Yes Thankyou labman. So I am to not contact Leeds council or bailiffs and just pay council, will they know I'm paying them direct and do I have to tell Jacobs bailiff I'm paying council?

        Re: scared of bailiffs

If you make a payment to them and it is credited to your account, of course they will see that you are paying them. Just pay on the same day, each week to quickly build up a reliable payment record. Once you have done this for 6-8 weeks we can approach the council with a view to them taking the debt back from the bailiffs.

I'm concerned about your comment, "Do I have to tell Jacob bailiff I'm paying council." I'm a bit at a loss how to say any more clearly, don't have anything to do with the bailiffs. Don't speak to them, answer the door to them, anything at all. Remember you need to stop them gaining a levy, so you will need to move your car and make sure they can't just walk into your house or climb through a window.

PLEASE don't do anything at all with the bailiffs - nothing, zero, zilch!

          Re: scared of bailiffs

I'm sorry just never had to deal with anything like this before so not sure what I'm meant to do. The bailiff rang me not 10 mins ago but I didn't answer my phone then he sent me a text say he needs to know a time to come tomorrow but I haven't replied. He told me last week he wants me to pay 50 pound and sign relevent paper work before considering a payment arrangment. If I pay 20 in morning to council and then every Wednesday do you think it will be ok? Do you think he will visit my house a lot? Good job I don't have a car and live in upstairs flat, my door is always locked. Getting really really scared with him coming tomorrow and I have both kids home at the moment due to my daughter having tonsills removed on 12th this month she's not been well but don't want her getting scared if he bangs at my door. Sorry for babbling

              Re: scared of bailiffs

You've no need to apologise at all. I honestly understand how you feel - when I had bailiffs on my back I knew nothing about anything to do with consumer law. I vowed afterwards I would learn all I could to stop anyone else having to go through the living hell Iwent through for two years. Incidentally, I've since got significant compensation from the council and bailiffs in question.

I can't answer your question about how often the bailiff may call. There is a well known phrase used on here though - Bailiffs Lie! What they say and what they actually do are completely different things. If you get any abusive texts keep them as evidence. If he does come and starts hammering your door, ignore him. Once he realises he's not getting anywhere, he will stop. Similarly, if he leaves voicemails sayinghe's going to come with locksmiths and break in or anything threatening, keep them abd don't worry about them. It won't happen.

I appreciate fully this is hard for you, but trust us and you'll be fine.

If you pay £20 tomorrow, make sure you can pay £20 every Wednesday for the foreseeable future.Stick to this religiously paying direct to the council. Don't miss any payments!

In post 3 I suggested you send a letter to the bailiffs - can you do this please?

Also, I suggested you phone the council to find out certain information - can you do that as well please?

Perhaps you can post up again when you've something to report from those two things - in the meantime, don't worry.

                Re: scared of bailiffs

Thankyou again so much for your help. I will phone council first thing in the morning, not sure what to say to them. Is emailing Jacobs any good or does it have to be hand written?

                  Re: scared of bailiffs

Just print out the letter in the link in post 3 and send it to Jacobs. That's it as far as they go.

                  As regards the council ask:

                  1. How many Liability Orders they have against you?
                  2. The dates they were obtained?
                  3. The addresses they were for?
                  4. The period of time each covers?
                  5. How much each one was for?
                  6. How much is still outstanding?
                  7. The dates they were passed on for enforcement?

Rung council at 9.47 this morning, they've got 4 liability orders. This years stands at 314.30. I paid 20 over automated phone system, I wrote reciept number down. Was about 10 min before I spoke to them. Would I have already shown on their system that I've paid this morning? She didn't mention anything

                          Hi,

Well done for phoning and finding that out. Do you think later on you could write down the other questions on the list and ask for answers to those as well?

I can't answer your question about the computer sytems and billing - I don't know how long the payments take to show against your account sorry.

                            Re: scared of bailiffs

They told me the years money is owed and how much and so far the bailiffs have added 24.00 for each liability order so that's 96.00 in fees so far. What should I do now, should I ask for council to take debt back? He's coming today I'm sat here bag of nerves waiting for bang at the door. Want to go out but I darent just incase I see him outside when I'm coming in or out of the door. I'm a wimp, that's doors locked and staying locked and ill probably hide under duvet with the kids. Times like this I hate being a single parent

                              Sorry PT - crossed post.

Being a single parent puts you into the vulnerable category under the National Standards for Enforcement Agents. Do as we said yesterday for the moment - get the letter sent to the bailiffs and have nothing to do with them. Take your kids to the park or something to distract yourself. I doubt they'll come.

he's just been. I ignored the door and kept kids in living room. He was going to post something through letter box but took it back out? He just text me saying he visited at 12pm but no answer and if he doesn't hear from me he will have to inform enforcement. Do you no what he means by that?
