Yes, but I would doubt they could do so lawfully.

Have you spoken to the Fines Officer of the court to get the varmints called off?

i think we spoke yesterday and she was happy the fine was clear and the rest was between bailiffs and us. in fact she seemed to be guiding me towards settling with them

FINES OFFICER confirmsfine is paid but cannot call back the papers from bailiffs .so bailiffs debt is good!
as helpful as he was the £75.00 letter fee and £200 attendance fee remains he has suggested i ring the Thames court direct (legal dept) TO POINT OUT THE ERRORS IN THE paperwork ?
              LOOKS LIKE WE ARE SNOOKERED?

                Re: Phillips Bailiffs

I'm not really sure what part of "you don't have to pay the bailiffs" is unclear to you.

Court staff are not legally trained and therefore are not qualified to comment.

                  Gooner Land,

If you decide to pay the Bailiffs then frankly you are being silly to yourself, they have no power at all in this case as no visits were made to you BEFORE you paid the account in full to the court therefore they CANNOT add fees to the account this has been done after you have paid this bill - you wouldn't go to Mcdonalds and pay £2.99 for a happy meal then eat it and expect to be given a further bill to pay would you?, this is no different.
Do not waste any more time or money on this ILLEGAL Warrant.

                    Re: Phillips Bailiffs

I suggested possibly doing the SAR to identify incorrect fees. I have to say, you have no need to as all the fees are unlawfully applied.

It has to be your choice, and I guess if £10 doesn't matter too much to you then it would be interesting to see how they try to justify the charges, but I would imagine you have better things to spend the money on.

                      thanks everyone for help -
spoke to court again last night and they have confirmed that they will put a 7 day hold on the bailiffs
not to pursue - although their debt of £45.00 IS CLEAR they confirm that the matter was passed to bailiffs on 26 /8 2011 my son paid on the 4/9.2011 inbetween that time that sent a letter to theour home but adressed to wrong name which we did not recognise and returned to sender.
the rest is as we have mentioned before.

I know the court has given you the date of 26/8/2011 as the date the matter was passed to Philips, but I would ask them to check this again. As I understand it (and I could be wrong here so maybe someone more knowledgeable could correct me if I am) But once the court has passed it to the bailiff, they are not allowed to accept payment and should have refunded the £45 to your Son.

Is this supposed to change anything? Because it doesn't.

Should the bastar... bailiffs prove troublesome, why don't you tell them to go away and bother the person named on that letter?

Ignore it, as you do not need to prove who you are.
