    My son recently paid an o/s courtfine increased from £30 to £45.00
    however SINCE THEN we have returned several leters to a PO box as they have incorrectly addressed
    Mr Lawd instead of Land it now transpires these have been from bailiff Phillips and they are seeking £275.00 from him . A caller came round with a letter although i explained the above and also advised him that my son and i have the same names and initials
    he just left another letter.
    My son emaild them twice explaining he had paid the court We have another letter today wrongly adressed (wrong name) FROM THREADS I HAVE READ this must be a pre removal notice.
    I intend to return this un opened with copies of the earlier emails (YES OR NO)?
    I HAVE NOT SEEN A WARRANT FROM hmcts OR ANY OTHER PAPERS ..
    WHAT IS THE CORRECT ACTION FOR US.. HELP PLEASE is it possible the fine was paid too late hence this problem? uNFORTUNATELY MY SON works abroad from time to time so hard to find papers etc.

      I would send the letter back to sender unopened with a note written on the envelope "NOT KNOWN AT THIS ADDRESS" as with all legal paperwork the details must first be correct and if they're not the warrant is invalid - after all how do you know that this letter is truly meant for you and not Mr Lawd??
      I would write to the court and check WHEN the fine was paid and make a note of this, you will probably find that the Bailiffs office haven't yet updated their system and it may just be a cross over, if this is the case you don't need to pay any more as it's their mistake.

        OK thanks everyone - step 1 recorded delivery returning this letter
        advising them that its not me etc.

        step 3 up date u all

            ok so i have just spoken to court and fine is fully paid but paid a week late .
            in that time the case was passed to the bailiffs .
            court are happy that their debt is cleared and simply refer us to bailiffs costs

            help?

              hi had a long chat with clerk at court and didnt really want to commit herself to any advise but confirmed that court fine was paid . even though court had sent out wrongly adressed letters too hence not paid on time, appreciate that is not a valid reason but as we did not receive reminders and then they pass on the wrong name to bailiffs? (or is it)?

                  Are they not likely to keep the fee paid, whilst responding that they do not hold any data on the person named in the SAR?

                  I know that it is customary to enclose the statutory maximum fee when submitting a subject access request under section 7 of the Data Protection Act 1998 (link), but is any fee payable when the subject primarily wishes to know, yea or nay, whether any personal data upon himself is held or processed by that company?

                    The £10 fee irrelavant i can get a postal order that way they have no access to any account details .
                    but i cant see how it will stop there ball rolling and charges escalating?

                        It won't immediately, but if the fine is confirmed as settled, then they have to give a breakdown of fees charged against you and the reason for those fees in the SAR. They have to give you everything they hold about you.

                        Once received, you can identify any legitimate charges (if any) with the help, if necessary of some excellent people on this forum, and pay what is legitimate. They are highly unlikely to be foolish enough to pursue the matter further for non-legitimate charges.

                          This is ridiculous, there is no way this fine, which was paid only one week late, could possibly stand now at £275.

                          The court has confirmed it is paid in full, therefore, the debt is discharged and the bailiffs are out of luck.

                          I would not be wasting printer ink let alone £10 on them.

                            I fully support this comment and agree, the Bailiffs are just trying it on, you are under no obligation what so ever.

                              I had a similar problem with Philips, I didn't send them a SAR, I just asked them for a breakdown of their charges, which they eventually did do. They tried to charge me £200 for a visit that didn't happen. I reported them to Trading Standards and OFT and informed Philips of this, and lo and behold the charges disappeared and they closed my account.

                              Maybe worth just asking them for a breakdown of charges and take it from there.
