    I came across this site whilst searching.

    Today I have recieved a claim form for a ccj dated 07.06.2024 on behalf of kearns solicitors never heard of them before and also the claimant lc asset 2 s.a.r.l in luxembourg very strange as we are in the UK.

    I know its for a catalogue jd williams as far as I was aware it was with link I believe

    The claimant claims the whole of the outstanding balance and payable under an agreement referance z***** and opened effectively from 26/11/20214. The agreement is regulated by the Consumer Credit Act 1974. Was signed b ly the defendent and from which credit was extended to. D failed with a default notice served pursuant to s87 (1) CCA and by 03.12.2023 a default was recorded. As at 16.08.2023the defendant owed jjd the sum of 2.386.09
    by an agreement I writing the benefit of the debt has legally assigned claimant effective 16.08.2023 and made regular upon claimant serving a notice of assignment upon defendant thereafter. Claimant claims 1. 2.386.09
    2. Interest pursuant to section 69 county courts act 1984 ar a rate of 8% per annum from 16.08.2023 to 07.06.2024 of 146.45 and thereafter at a dailt rate of 0.50 to date of judgement or sooner payment ddate 0y.06.2024

      a) First Acknowledge the Claim, you can do this online via MCOL, this will give you 28 days (plus 5 days postal) in total to work on your defence.

      b) Send a SAR request to JD Williams, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

      c) Send LC asset 2 s.a.r.l a CCA request, they have 12 days to provide the requested documents. Make sure you get Proof of Postage.

      d) Send a CPR 31.14 request to kearns solicitors, they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage.

      e) This is an example Defence, start looking at it, don't fill or file it with the Court or their solicitors yet.

      Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.
