CCJ Claim for Lowell for Mobile Phone Provider Debt. Please Can You Help.

Hi,

Today ive received a claim form from Nothampton Court for a CCJ for a debt with 02 & Lowell.

I posted a letter in March to lowell asking them to prove I owed the debt they replied among other thing ;

"the deed of assignment will not be sent to you as it is a confidential agreement between our client and the original creditor containing information to which you are not entitled to see. No other agreement/Deed of novation exists between you and our client"

"Our client is also under no obligation to provide you with sworn affidavit or a signed bill"

I've heard nothing else since except a this county court form.

Ive been trying to improve my credit rating the last years and using clear score and this account isn't showing on my credit report.

Ive read through some advice and it seems to CCA letter does not apply to mobile phones is there anything I can do? Any help advice is really appreciated.

FOTL letter sent to them! oh! dear?

you must of received letter of claim prior to N1 form.

Sorry what does FOTL mean? I've received letters prior to N1 saying I owe the money please contact us to arrange payment so I used a template to request information, since they replied saying they don't have to supply the information i've heard nothing directly off them only this N1.

FOTL = Freeman Of The Land (the letter you sent asking for the "DEED of assignment" and a "Sworn affidavit" sounds like one of their templates) can you tell us where you got the letter template from??

You are going to have to Acknowledge the claim (can be done online via MCOL ~ http://legalbeagles.info/library/gui...y-court-claim/) and send off a CPR request asking for the documents mentioned in the PoC on the claim form (http://legalbeagles.info/library/gui...-of-documents/)

Hi, thanks for you replies I've acknowledged the claim and received a reply for the CPR.

They have enclosed a notice of assignment which they say was sent to me originally by 02, which outlines the money owed and its says "As well as this letter,you'll have had a letter from Lowell Portfolio I LTD too. Its called a notice of assignment. This tells you what we've legally assigned you account to Lowell"

They have also included that Lowell letter.

The letter from 02 i'm fairly sure I've never seen before it's not on any headed paper or with any logo and its not signed it just ends
