Re: Recieved an Acknowledgment of Service

On the claim that I have issued at present is roughly £1,500 in expenses & compensation on car No1 for poor workmanship to my car, with an additional claim of £500 in misleading me into signing a new contract on car No2.

I would like to know if I can take off the additional £500 claim that mislead me into signing a new contract on car No2, and file a separate claim on car No2. The reason being is that now that my car is due its first service and the dealership have now refused to service my car because I am taking them to court leaving me with only 8 days to find another reputable Vauxhall dealership in order to reactivate my 5 year warranty. The dealership says that they intend on returning my £331 that I had paid them in monthly instalments for my service plan. There was also 3 minor points of damage to car No2 when it was in the dealerships care and I will have extra costs in travelling to the next nearest Vauxhall service centre, and I intend on claiming interest on the £331 that was in my service plan pot.

If I can take this £500 off claim No1 and file a second claim, how do I go about this, or do I need to cancel my present claim and reissue another claim???

Or you could stick with your claim and use a different dealer for your service and reclaim the additional costs from them ?

Is the servicing part of the contract you are complaining about being misled into ?

No, the service plan was an additional extra that I took out when I purchased car No1. When they replaced my car the service plan rolled on to car No2. The dealership just made up the direct debit mandate and I signed it.

There are delays/backlogs in some areas but this is not normal, check with the court by phone to check on the status of the claim.

The claim may be stayed if the claimant has not responded to your defence.

I am the claimant and the last forms that i filled in was the DQ. for the court and a copy for the defendant.

                        Hi Guy's,
Upon filing at court a letter containing further details of my claim, the court has ordered that i send this to the defendant by 21/12/16 which I have
The defendant must send to the court and myself an amended defence by 04/01/17 to which they have.
If in the light of an amended defence, either party wishes to change any or part of their answers on their allocation questionnaire then we must do so by 18/01/2017
Is the allocation questionnaire just another term used for the directions questionnaire as the DQ was all that I received from the court months ago which I sent in.
