  • Recieved an Acknowledgment of Service

    Hi Guys,
    I have a question for you.
    Got a letter today from the County Court Business Centre stating that an Acknowledgment of Service of my claim has been filed today, a copy of which is attached.
    The defendant now has 28 days from the date of service of the claim form to file a defence.
    My question is, if the Acknowledgment of Service was filed on 12/05/2016, when does the 28 days elapse. I don't know if the 12th would count as one of the 28 days, so would it be 08/06/16 or 09/06/16 when the 28 days are up???

    The 28 days is from the service of the claim to the defendant, which is taken as 5 days after the date of issue of the claim, the date that is on the N1 court form. The date for the filing of a defence is not connected with the date of the Acknowledgement of Service.

      My Claim was submitted on 02/05/16
      My claim was issued on 03/05/16
      so i take it that the 28 days will be 05/06/16 yes?

        Question as to where I should send Form N180

        Hi,
        Today I received the defendants DQ and Form N180. In the N180 it asks what county court I wish for a court hearing so I opted for my nearest court which covers my jurisdiction.
        My question is to where do I send the N180 form to, the county court in which I have opted for on the form or do I send it all back to Northampton CCBC?

          N180 Must be copied to the NCCBC And the claimants solicitors.

              Yes, usually the nearest to your home, occasionally if courts are busy it could be a little further away.

                  Hi Guys,
                  I have another question for you.
                  In May 2014 a Vauxhall Field Technician inspected the paintwork on my vehicle and compiled a report.
                  Vauxhall authorised a re-spray to damaged areas of the vehicles paintwork.
                  After a little more complaining to Vauxhall and a request to see a copy of the report, Vauxhall finally agreed to a full re-spray of my vehicle but would not let me see the report as they said that this was for internal use only.
                  In June 2014 my finance company sent me a letter stating that Vauxhall confirmed and accepted that a paint defect had developed on my vehicle according to a report completed by a specialist paint engineer on the premises of the dealership.
                  Today I received the defendants DQ and they state that one of their witnesses will be the Vauxhall Technical Field Manager whom compiled the original report, with his opinion on the issue with my vehicle. The dealership has called him as a witness saying that there was no manufacture or material defects with my vehicle.

                  My question today is, will the letter that I received from my finance company act as evidence towards my vehicle actually having a defect in the paintwork or will the Judge favour the opinion of the expert?

                    My car is due its first service in less than 2 weeks. The dealership where I purchased my car and to which I have made a claim against are now refusing to service my car. I have been paying the dealership a monthly premium for a service plan for the past 12 months, although they say that they intend to pay back all off my premiums back into my bank account, can they refuse to service my car at such short notice?

                        Nothing in writing, only bank statements which say plan my service and amount deducted each month.

                          they want to play hard ball..after the problems you have given them...if theres nothing in writing that they have to service your car.. may be thats their point..they don't want your custom

                            My claim has been transferred to Newcastle upon Tyne but I don't have a date yet for the hearing. Now there has been a change of circumstances, how do I go about amending my original claim?
