      Hi you,

      No I am not paying anything at the moment, I can take up the offer of the 25% off and start paying something off?? do you think that is a good idea? x

      The CCJ won't 'expire' but it won't show on your credit file after April. The CO will stay until your debt is paid off. Are you paying installments or anything to this debt ?

      Only way to ditch the CO is to negotiate with the creditor ( holder of the charge) to pay if off and have it removed.

          Its Mortimer Clarke Solicitors acting on behalf of their client Marlin Capital Europe Ltd, it was sold to them about 2-3 years ago. The origianl CO was registered by Northern Rock as part of the original CCJ dated April 2010. its for £17 grand and change

                Hi sorry you post have been missed it's been rather hectic.

                Are you making an offer of full and final settlement? Or just taking up an offer of a 25% discount and a payment plan?

                    Right, no, although the CO stands and the CCJ stands, it will fall off your file at the end of April, and they will have to apply to the court to take any enforcement action after April 2016 ( as they have 6 years to take enforcement action) So unless you can afford a deal to pay off the whole lot in one ( unlikely I know for £17k ) then I'd keep shtum and after 6 years from the Judgment THEN you can think about negotiating to settle the debt to get the CO off your property.

                    I think you said there weren't any threats in their letter, ie no threat to apply for a sale order etc ?? If there are any threats or indications to them applying for a sale order then of course you must speak to them.

                    On your Land Registry docs is the Charge in Northern Rock's name or Marlin/Cabot's name ? Have you checked if it has been transferred ?

                            Hi, I have copied a pasted teh bit where is says, its not even to NRAM just still Northern Rock!???! nothing about Maplin and it was updated in recnetly. so........

                            I dont understand if NRAM or NRock were going to get the money eventually through a sale or remortgage why would they sell the debt!?!?!? it just doesnt make sense to me.

                            registered before the entry of this restriction, is to be registered
                            without a certificate signed by the applicant for registration or their

                              Okay in that case I would be inclined to do nothing regards the letter from Marlin. They can't apply for a sale order and they don't hold the charging order. they haven't threatened a sale order - and it is just a restriction anyway - so when you remortgage / sell it will be flagged up and Northern Rock (it is NRAM Northerm Rock Asset Management) can claim their £17k from any equity. Plus it only seems to be an interim charging order so has never been made final.

                              Do you recall much about when you lost the case brought by Northern rock for the loan, did you get land registery papers and notification of a final charging order hearing at the time ?

                              It wasn't a 'together' loan was it ?

                                Hi ya,

                                It wasnt a together loan no, not secured against the house it was unsecured. I didnt attend the hearing, the order and everything was made in my absence. To be fair at that time I wastnt living at the property as my husband and I had seperated and I was living someone else and he never opened any mail (it was a bad time). I only know about the order throught the letters received in 2014 from Mortimer Clarke.
