Maybe a phone call to shop direct to ask why Lowell are chasing you.
I can not hazard a guess as to why your shop direct account is showing active. If you need stuff editing and uploading you could email it to Kati . Her email address is in her signature

It appears the debt for £1200 Fredrickson/ lowell have been chasing me for and sent me an annual statement for is in fact one they tried to take me to the small claims court for but the judge threw it out on account of Lowell not complying with the courts requests for information from them. So the court has told me to ignore any further letters with regards to this debt. I wonder if this now means i can get this one took of my credit history as there still showing me as defaulting each month.

The debt for the very account for £1582 is been chased by lowell/moorcroft and still showing as an active account, iv tried to speak to someone at very but they told me to phone 08702400840 which i cant from a mobile as my phone bill will be through the roof.

Im so sorry for all the confusion, i will try to borrow a friends phone to contact very and keep you updated. Im really thankful for the help you guys have given me id almost given up.

Just spoken to very and they no longer have the debt as they sold it to Lowell, the lady said there wasn't nothing they could do with regards to the account still producing statements but they have nothing to do with the account any more.
Can i write to lowell/moorcroft asking them to stop harassing me as the cca request was sent on the 14/12/15 but the copy of the credit agreement wasn't sent out to me until the 22/01/2016.

The fact that it was late is irrelevant I am afraid, It may be that what they send did not comply with S78(1) although by the sounds of it, it likely did

there is no signed statement of account i.e amount owed and state of the account so should i try and wing it and send them a letter to tell them that what they sent does not comply with my S78(1) request and therefore as S78(6) says the account is unenforceable?

All that is needed is a signed piece of paper with the current balance on it

No harm in trying

oh i see. There is a ticked box to say i signed, no actual signature, but no current balance, just a credit agreement.

Im not sure if its an original copy from when the catalog was opened or if its an amended copy.

Iv tried to scan it to day to upload but my scanner isnt working right

The phrase " irredeemably unenforceable" was this ever used?
If the above was stated the there would be a case for removing the record.
But if the claim was struck out for non compliance with the courts orders it can still
be reported and chased for payment.

What exactly does your credit file show? Are there two entries for this the original creditors showing a default date and " Settled " ? Then Lowell's updated entry with the same default date?

The default date must be the one registered by the original creditor. Lowell Cannot change that date.

I would be contacting the court and asking for a copy of " The Judgement Order" this could be very important.
