lowell/ fredrickson annual statement

  • lowell/ fredrickson annual statement

    Hoping someone can help, Lowell was chasing me for a shop direct account, so i sent them a CPr 31.14 request back in December 2015 and they was unable to send me any proof they owned the debt.
    I was hoping that would be it but today iv received a letter from Fredrickson international representing Lowell of an annual statement of said debt with over £220 added for interest, fees and adjustments.
    What should i write to them with regards to them failing to comply with the cpr request and to stop chasing me?
    Id be very grateful of any information in helping to get them to leave me alone.

          Have court proceedings started, in that you have received a claim form and response pack from the courts?

          Do you mean a CCA request or a CPR one? They are VERY different things.

            Sorry I meant cca request, no not on this one but I thought if they didn't comply with the request they couldn't chase you any more.

                Good morning.

                Were solicitors involved last year?

                You should now send a CCA request to Freds for a copy of the SD agreement, a £1 statutory fee is payable, please be careful on these points.

                Use a postal order for the fee " write " For Statutory Fee Only " on both sides and keep a photocopy for your records.

                Use the template from the forum library and send the request by signed for post, check date delivered and get a copy of the signature.

                Freds have 12 +2 Working days to comply.

                    The annual statement is not anything to be particularly worried about , it is a requirement and it seems that they are catching up on the sending out of theses, in some cases sending 3 or 4 years with all at once.

                    Remember that Fredricksons are just another part of Lowell

                    As it is only 2-3 months since you sent the CCA request
                    Did they respond with something that was rubbish or did they respond with a letter saying they haven't got the agreement

                    I personally do not see the point in sending a second CCA request
                    Just write to them and say
                    On XXXXXX I sent a request under S77-79 CCA , to date you have not responded(or whatever it is-might be a case of what you sent me did not comply with my request) . I know its only £1 but you any should they have it when you are in the right

                      According to Unknowns posts it was a CPR 31.14 request that was sent last year so a CCA request is entirely appropriate.

                          I received a copy of a credit agreement from moorcroft with regards to a very catalog it is 4 pages long with my name and address printed at the top of the first page, on the second page at the bottom there is a printed customer signature with the date and a tick in a box which says tick here to sign and accept agreement. There is then two pages that are all about your very account. The enclosed letter simply has a reference number and please find enclosed a copy of the agreement and that they are putting my account on hold for 14 days so I can decide what I want to do. There is nothing about how much the debt is for.
                          The debt is still with lowell though so iv totally ignored the moorcroft letter but they keep sending me emails and texting my old phone number which is annoying as my daughter uses the sim for an emergency phone when walking home from school.

                            It sounds as if it may be enough to satisfy your S78 request.

                            when was the account opened, was it done online or over the phone?

                            If you can, post a copy up removing personal details .

                            A few more questions I'm afraid
                            Didbyou receive a notice of assignment telling you that it had been sold/bought?

                            Did you receive a default notice when you started missing payments, if so do you still have it. If you do can you post that up as well.

                            I know it sounds a lot but people may be able to suggest if you have a defence should a claim come your way , after that it will be up to you to decide what to,do

                              Account was opened around 3 years ago i think, the account was set up online. I was getting online statements and the defaults was on there. I stopped paying as phoned up to ask if i could pay one day late and they said yes they would put a note on my account and there would be no default on the account then when my next statement came in there was a late payment charge and another charge they refused to remove it so i couldn't afford the charge and the months payment, from then on there was charges every month.

                              I will post a copy of the letter tomorrow as im unsure how to upload it.

                              I dont believe i had a notice of assignment.

                              I would try to reach a payment plan with them but only if they would remove the interest charges and default notices which i doubt they will.

                              Iv just logged into my very account which i haven't done for months and there still adding interest every month and they have me down for owing £1582 wheres lowell are saying i owe them 1200 so now im confused, should i contact very? if they have sold my debt shouldn't the account be closed? or can i arrange a payment plan with very?
