            hmmmm interesting.

            FIRST -


            there was no need for any finance as the van cost was 41,500, you paid 24500 deposit and had 17k part exchange.

            You did still have the settlement on the BPF loan to deal with though as that isn't accounted for in that.




            SECOND - ( 2 weeks after the first)



            well that makes the price of the van the same £ 41,500) with (( 24,500 deposit amount plus £17000 part exchange )) - and the loan is purely to settle the previous loan. something very odd about it which I can't figure out yet... think we need more info.

              So to me it should read


              Total Price 41,500
              plus settlement (of previous loan) 32812.16
              Total - 74312

              less deposit paid £24500
              less GIA to sale xxxxx
              less part exchange £17,000

              net balance due - £32812

              Finance £32812


              and that makes total sense then.

              You basically took out new finance to pay off the old finance only - so lets reconcile that with the CCA.

                Yes. I just don't know anymore I feel like I am going mad.
                I have just received a final email from the Adjudicator she has really tried to put me in my place.
                I must be seeing things that are not really there because she is saying that she does not agree with me and II have been given the £17,000 by GS.

                  Yes you have.... they have done something wonky to get you the new loan to pay off the original loan. That's why it;s all a bit arse about face. The new VAN cost you 41,500 - which you paid for in cash and p/ex entirely ( £17k part ex and £24500 cash). The new loan was solely for paying off the old loan settlement of £32812.

                  I'm really not suprised you're confused, those invoices are a balls up and the agreement really isn't clear at all. I'm not sure of any consequences of the loan being stated as being for one thing but actually being for another....will try check that out for you, but yes you have had the £17k p/ex.

                    So they have bought your old caravan which was under a year old and you bought for £45k ? for £17k, then they have sold it to your friend for £45k.

                    Nice work if you can get it and not suprised you are pissed.

                        It's okay, I am really not surprised.

                        Basically you paid for your new caravan in cash (£24,500) and the £17k part exchange.

                        You are paying off what was left on your original loan yourself, with a new loan.

                          Omg I am physically sick and upset My daughter was with me. It was my pension money. I was buying this place to live in. It was supposed to be my home. They have lied to me about everything and I am on my own and cant fight them by myself.
                          Now I have a snotty Adjudicator looking down her nose at me I really do appreciate your support because no one can understand. I shown this to a financial advisor in the beginning and he put his head in his hands and said you need to speak to BPF about this But BPF just ignored me for ages until the Ombudsman service got involved. I don't know what to do now I am paying £453 a month and I am not even living there and I cant pay this anymore. If you want to see the Adjudicators letter I can forward it to you, she just tries to make me appear stupid.

                              It needs some thought. I'm thinking that the credit agreement is based on, basically, lies. The finance with BPF is based on a sale of a caravan at £57312.16 - which is basically an invented figure to make the maths add up to get the loan to pay off the old loan.

                              I'm not all that up on conditional sale agreements so will have to read up on them and the Consumer Credit Act rules.

                              Yes could you forward me the adjudicators letter, we might be able to form a response to make them look at it from another angle - as you've concentrated on this £17k in your complaint to date.

                              What has actually happened to the van now ?
