May I ask if I can send via your email, my details of court papers, as I am unable to scan them, they have also enclosed a n244 form, also I do not know how to get them from photo on to here

I forgot to say that they said they will suspend it for now, I can not remember the word these used as I was to worried, as they were saying they could offer me a discount if I paid , sorry

That's the print out the court sent you isn't it. All looks quite standard. Did the court say where they had sent the original claim?

No, that was all, mortamar Clarke did say they would look into it to see if they could set it aside??? I have to wait 14 days they said

Okay just going to summarise the situation then, if you can confirm if I've got it right.

• You received the claim forms originally but thought they were fake so binned them
• You found you had a CCJ from your credit file
• The original debt was car finance, taken out with 'online finance' in 2002
• You gave the car back and made an arrangement to pay the shortfall at £3.00 per week
• The £3.00 payments each week stopped in 2006
• You've not had any further contact regarding the debt until the court claim

Yes everything is correct, expect I got no letter explaining that I had a CCJ, I found that by looking at my credit report.

Have you looked into the fee remission to see if you are eligible ? Look for form EX160 on the HMCS website.

Otherwise there will be a court fee of £50 or £155 for the application to set aside.

If Mortimer Clarke agree to the set aside then it would be £50. If they don't then it will require a hearing and that will be £155.

Maybe, best to start on putting together your set aside application then.

If you show you have a defence then it is likely to be set aside.


Would like to know a bit more about what happened with the finance at the time you gave back the car. How much was the shortfall etc ?


You need to send a CCA request to the claimant - http://www.legalbeagles.info/forums/...y-of-Agreement - with a £1 - you can get that done today.

If they don't have it then that causes major problems for them, if they do have it we'll be able to check out the terms of the agreement and whether it was valid and how it SHOULD have acted on return of the car.

Well, in not aware of a shortfall, I had a car which at the time was not suitable, I was then told I coukd get another, but not informed I had negative in the car , but I have no paper work it was quite a while, so no real numbers for you , sorry
