Can it not be said that the item was mis-represented, in that the item itself was not as described - or portrayed - in the catalogue ? Let's face it, Ann Summers clothing relies heavily on visual appeal, and the goods must be 'fit for purpose.' That surely must mean they should not only be comfortably wearable - WITHOUT a layer of thick underwear ruining the appearance - but look good, too. Cheap stitching digs into the skin.

OMG - did I post this ? :whip: :bolt:

Yeah - that 'No Quibbles' thing seems to be the main thrust of our approach here. Do they REALLY mean 'NO' ??? It's one of those advertising clichés that needs tying down, I reckon. What EXACTLY is a 'quibble' in legal terms ? Is it anything like a 'safe word' ? Deffo needs defining, IMHO.

I'll be sitting here, ready - as usual.

As usual - he will take one look into my eyes and bang on the central locking and speed off. That's what they always do....

                HI
Yes Bill as usual you have hit the nail on the head. As I mentioned in my earlier post, the question is, is the item fit for purpose.
I suggested that the OP should pop in to the aforesaid garment and post the picture. I am sure we are all mature enough to give a dispassionate opinion.
Developing the thought further perhaps a thread would be in order, so we could compare the garment with other contributors for a more informed view.

I agree with you to a point, Peter. In this case, the product is not as expected and the quality is poor. I would say "not as described" and "not of satisfactory quality" under consumer protection legislation could swing this in the OP's favour. In any case, Ann Summers should know the law. I've come across retailers trying to fob off customers who are due a refund under consumer protection legislation with credit notes and have had warnings from TSOs about it.

Yes as i mentioned you could have a go at saying the items were not of "Merchandisable quality ".
The problem is that garment and things are so subjective, as i tried to illustrate.
Thousands of pounds are paid for dresses that consist of a couple of quids worth of material who is to say if it is of merchadisable quality.
Yes i am sure you are right they will have a good understanding of the law you can bet on it.

If, as I would guess (never having been invited to one of these gatherings), the item was purchased via a catalogue, it would be a simple case of comparing the bought item against the advert (ASA, perhaps?)
Oh, & finding a 'reasonable man' (as per the 'Clapham Omnibus'),to decide.
