    Particulars of Claim:
    The Claimant Claims the sum of £xk for the outstanding debt owed. On XX/2000 the D entered into an agreement with BB UK Ltd for a CC under reference XXXXXX . ) On XX?24 the D defaulted on the agreements with outstanding balance of £XX.

    On XX/24 the debt of £X was assigned to PRA Group(UK) Ltd who itself assigned the debt to PRA Group UK Portfolios Ltd on 17/6/24. Notices of assignment were sent to the defendant in accordance with S136 Law of Property Act 1925. The Claimant has instructed PRA GROUP (UK) Limited to act on its behalf in the recovery of the outstanding debt and to pursue litigation on its behalf. AND THE CLAIMANT CLAIMS 1. The sum of £XX

    It's the administration for claims. It will be transferred to a local County Court.

    You can request documents they've stated in their Statement of Case, so Agreement, Default Notice and Notice of Assignment.

    No, if they aren't complying with your SAR request, then you can make a complaint to the ICO, providing you've done everything you should have, i.e. made the request, given them 30 days to provide the requested documentation, sent a chase letter, still no response, then a complaint to the ICO.

    a) First Acknowledge Service of the Claim, you can do this online via MCOL, this will give you 28 days (plus 5 days postal) in total to work on your defence.

    b) Send a SAR request to Barclaycard, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

    c) Send a CCA requests to PRA Group, they have 12 days to provide a copy of the agreement. Make sure you get Proof of Postage.

    d) Send a CPR 31.14 request to PRA Group, they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage.

    e) This is an example Defence, start looking at it, don't fill or file it with the Court or their solicitors yet.

    Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.

      do I send copies of what i send to the claimant to CNBC?

      I performed a DSAR some time ago and they provided me a copy of the agreement ( although my details appear on the first page no signature page was accompanied) PRA said if I wish the original or this page I should contact Barclays.

      I'm confused , if they purchased the account why has Barclays kept this significant page?

      is there any point in requesting the agreement again?

        No. If you had to, I would have stated that.

        It sounds like they provided a reconstructed agreement, when in your case they should provide a original copy.

        You really need to forget about the SAR (although it can provide useful information).

        You have to send a CCA request to PRA Group, they need to provide that information to you.

          I've had a cnbc for £331 back in 2022. I filled out a form asking to set it aside and had to pay £350 or there abouts. I hope that's the cheque that cleared today as I sent two off to the courts, but in that time one dropped off.

            Ask to get it set aside as you never received any paperwork. If you did and it's signed for you're screwed.
