Hi just need some advice about an old debt from Nawest being handled by Equivo
Have been paying £20 pm but they want the debt paid due to timescale and instructed Equivo to send a court pack which I recieved.
Have repeatedly asked Equivo for Consumer Credit agreement verbally and by post with recorded delivery within the timescale but they are saying they havnt recieved it!! Have also sent request by email with copies of recorded delivery as proof.
Things have now escalated and have recieved County Court documents from Northampton
Which I filled in online allowing another 28 days for my defense.
My question is where do I go from here?
Do I have a Good defence with NO TRUE CCA seen??
Any advice welcomed

a) First Acknowledge the Claim, you can do this online via MCOL, this will give you 28 days (plus 5 days postal) in total to work on your defence, you've done this. - You've done this.

b) Send a SAR request to Nat West, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

c) Send a CCA request to the creditor, they have 12 days to provide a copy of the original agreement. Make sure you get Proof of Postage.

d) Send a CPR 31.14 request to their solicitors, they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage.

e) This is an example Defence, start looking at it, don't fill or file it with the Court or their solicitors yet.

Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 5 days before it's due we can help with your Defence.
