    I would suppose that if you find out from Tessera what the debt is first, if it is valid and you would accept the CCJ / charge on it and everything was in order (beside their dodgy paperwork) then you wouldnt have to go through the whole process over again. Its most likely if it is a valid debt you would want it set aside to ask for installments/get rid of unfair charges and dispute their paperwork anyways. But would be worth finding out what you are fighting against first.

    Have you asked Tessera what it relates to? I wouldnt think a call asking where the debt originated could hurt, just don't admit to anything.

    Also the court should have sent you copies of the original POC etc. Have you asked them again for those?

        Sorry - Particulars of Claim (the information this Tessera company entered on the N1 claim form when they put the intial claim into court) I suspect this was probably extremely lacking in detail too, but SHOULD contain where the debt originates and the account numbers (though rather too often it doesnt and things just get rubber stamped through the bulk clearing centre at northampton)

          I am still clueless as to where this debt originated. I asked the courts and Tessara to send info re the debt but all i have recieved off Tessara is a letter off thier solicitor stating it is from Egg but no other info. The court have sent an acknowledgement letter stating my letter will be put on file until the forthcoming charging hearing. I have got my credit history of Experian and i have noticied something i cannot explain. On linked addresses it has the full address of a company i had worked for and left in May 2001 the source is DIRECT FINANCE COMPANY LTD, date of Link 09/09/2001 i did not have a credit card for this company so why would thier address be on my file?. If i cannot get info from the company taking me to court how can i find out where the debt has come from surely a court judge will need to see something? I'm finding this whole saga really worrying. I live in Manchester and have to take time off work to travel to Southend County Court in Essex for a court case i have no info on. If anyone can advise i would be so grateful. Thank-you Leway

            Have you ever had any debt/cards with Egg ?

            Re your old office being linked, could you have used their address for contact paperwork on loan/card apps anytime?

            You should contact the CRA and ask to be disassociated with them.


            you won't have to go to southend, you are entitled as a Litigant in person to have the case transferred to your local court, you need to send a letter to the court to ask for this.

              No i Have never had an Egg card. No i never used the company details, do you think it unusual that i left the company in May 2001 and the link is dated Sept 01. Bye the way Thank-you so much for helping me and replying so promp.

                Yes it is weird, definately get the notice of disassociation in.

                Did you contact the court for the original CCJ paperwork ?

                    god they are so rubbish.

                    okay well as you have no idea what this is for a no one will tell you you need to get your application for the judgment to be set aside.

                    Removal of CCJ's - Main Menu

                    You need an application without notice N244 and list the reasons the CCJ should be set aside; some thing like;

                    I did not receive the summons (say if you have moved recently) therefore I was unable to defend this claim.

                    I did not receive any notification of the judgment.

                    I have no knowledge of this debt. I have contacted the Claimant and they have not been able to advise what the debt is.

                    I have a realistic prospect of successfully defending this claim.
