    Hi, the above has sent me a Court claim. B4 that I went through the 3 letter process of conditional acceptance. All this time I was acting as if they had bought the debt from Barclays Bank, but just found a letter from Barclays saying that they have transferred the account /debt over to PRA group . does that mean PRA are just managing it for Barclays or have they actually bought the debt for a measly sum? I'm in the process of sending letters with £1 postal orders and so forth....Just wanted to know if I need to go thru this with them. I have other debt managing companies and I'm currently paying a nominal amount to them, and was thinking that if PRA are managing the debt then I can have the same arrangement with them. However, maybe all the other debt managing companies have all bought the debt from the original creditors?? Hope this is a clear question and not a jumble!....grateful for reply.

    You want to find out if Barclays sold the debt to PRA Group, if they did, there wil be a letter of assignment.

    a) You need to Acknowledge the Claim, do it online it gives you an extra 14 days to work on your Defence, gives you 28 days (plus 5 days).

    b) Send a SAR to Barclays, they have 30 days to provide all the data on the account, make sure you get Proof of Postage.

    c) Send a CCA request they have 14 days to provide a copy of the agreement, make sure you get Proof of Postage.

    d) Send PRA Group a CPR 31.14 Request, make sure you get Proof of Postage. They should provide the document's they are relying on to make the claim.

    You need to keep an eye on the date that your Defence is due to be lodged with the Court and Creditor. If you don't the Creditor might get a CCJ against you.

      Just trying to find out what I need to do next. I have completed acknowledgement of service within the specified time, but have only now just heard from the original creditor. Is it too late to make a defence? the date of service was on 9 November..

        Just get the Defence done, it is late. email it to the Court and the creditor. The Acknowledgement of Service gives you more time, but it doesn't extend to 'file it when you want'.

          Your defence should have been submitted within 33 days of the issue date.

          Check the status of the claim with the court. You might still be able to send your defence

            Hi, it seems that providing a defence is still an option.

            I've had a look at the defence template and it doesn't fully apply to my case as claimant has written back to me and provided copies of letter of assignment....

            Is it enough to put in layman's language that PRA group bought the debt and there is no agreement made between myself and PRA, and therefore no contract?

              does not work that way , they bought for pennies and now are the owner so read around site PRA and get an idea how ro deal with it.

                No need for an agreement, they bought the debt and you got the letters of assignmemt
