    Have you Acknowledged the Claim?:No
    Claimant’s Name:Capquest
    Solicitors Firmrydens
    Original Creditor:MBNA
    Particulars of Claim:
    1 The claim is for the sum of xxx in respect of monies owing by the defendant on a credit agreement held by the defendant with MBNA under account number xxxx upon which the defendant failed to maintain payments.
    2. A default noticed was d upon the defendant and has not been complied with
    3. The balance owed was assigned from MBNA to the claimant, and the defendant has been notified of the assignment by letter
    Is the debt Statute Barred Don’t know. I don’t recognize the debt . It is not on my credit file so I have no way of knowing what this debt is or how old it is or even if I owe it at all.
    List any letters you have sent No letter sent yet as I don’t know which one to send

    I was advised by Stepchange to dispute this claim on the grounds
    that I do not recognise the debt. It is not listed on my credit
    file and I have received no correspondence related to this debt. I
    was also advised to say I need more information before I can
    proceed with a response and that as this debt is not on my credit
    file I believe this is statute-barred
    I have sent a letter to the claimant directly

    Did you just put a defence in rather than acknowledge? Before the 15th November? Just making sure you have something in on time so you don't get a default judgment xxx

      I replied online with
      Defence
      I was advised by Stepchange to dispute this claim on the grounds
      that I do not recognise the debt. It is not listed on my credit
      file and I have received no correspondence related to this debt. I

        Court sent me an acknowledge letter stating a copy has been sent to the claimant if the dispute cannot be resolved informally the claimant will inform the court he has 28 days to respond

          Okay so you did file your defence and all is okay


          First thing then - send a CCA request to Arrow - CCA Request - you do need to put a £1 cheque or postal order with it. This is important as if they cannot comply with the request you have a good defence to the case regardless of the rest.

          Also to Drydens send a
          CPR 31.14 Request asking for credit agreement, default notice and notice of assignment.

          and send a SAR directly to MBNA - Subject Access Request Letter
