Court letter

Please help, received court letter filled by Lowell on behave of talk talk, I have been with talk talk for over 3 yrs, when I decided to change my provider they tried to offered me discount but I refused. Later received a call from them that I recently upgraded my account which I know I did not, I then requested for copies of the upgrade account but did not received it. Now they have taken me to court. Please help.

Is the letter you have received a court claim from Lowell via Northampton County Court Business Centre with a claim number top right?
If so, can you type out the particulars of claim, and the issue date on it pls. Then you should get on moneyclaim online and acknowledge the claim ( Acknowledge Claim

) and then you'll need to send a couple letters ( will know what to ask for when we see the particulars)

Definitely though you will need to send TalkTalk a Subject Access Request Letter to get details of the account

Send a SAR request to TalkTalk to get all the information they hold

letter to Lowells asking for all documents they intend to use in the claim in order to narrow the differences between you, as expected by the courts.

Acknowledge the claim using the details and password on the form with nothing in the defence at this time. This gives you 33 days from date of issue to get your defence to the court

Please l need help, receivied a Directions Questionnare already filled up from Lowell and none from the court yet. Don't know what to do please help.

So either check with the court if they have sent out a DQ to you or download from the internet and return to the court and a copy to Lowell.

What did you put in your defence, andcwhen?

Thanks for your reply I contacted the court today and was told that no DQ has been sent out to me because they are still waiting for Lowell’s reply My defence was sent on the 27/9/19 and my defence was Lowell did not sent me information requested.

Why are you splitting this across multiple threads? Makes it difficult.

Not a strong Defence, it should really have pointed out that your contract had ended. You will have to try and introduce it in your witness statement.
