  • hi, could anyone please help me prepare my defence?

    on 24/10/18 i received a county court claim form from lowell solicitors dated 22/10/18

    i acknowledged the claim on the money claim website the same day, i have sent a request letter to lowell solicitors which they replied with a couple of letters form 2017, both stating that all respective rights to the debt had been signed over to lowell portfolio in 2015, their solicitors reject my claim that the debt is statute barred as they claim i made a payment to the original creditors (am i right in thinking they mean lloyds here?) early 2014. I have no recollection of said payment and they haven't provided any evidence of the payment too me.

    they state in their response letter that they have requested the agreement and default notice from original creditor and they will be sent to me upon receipt of them. i have also sent the SAR to lloyds but as yet have had no response

    according to my calculations the 28 days to file my defence is up tomorrow but I'm sat here at an absolute loss as to what i have to put in the defence form, could anyone please help point me in the right direction of what to include and how to set it out in the form

      I'm afraid none of us can assist you without actually know what the claim is for - you've given limited information so you are only going to receive a limited reply.

      More information is required, need to see the particulars of claim, background history , what steps you have/have not taken etc.
