  • Asset Collections and Investigation and TM Legal Services

    I have received two emails, one from Asset Collections and Investigation and the other from TM Legal Services, about the same debt a day apart.
    in 2013/4 I was a victim of identity theft and loans were taken out in my name with Lending Stream. I made it perfectly clear these are not my loans and that I accept no liability for them. In September last year ACI applied for a CCJ which I defended. The case was due to be heard towards the end of November, but was struck out by the court two weeks before the court date.
    Due to problems with Universal Credit I have no alternative but to take put a DRO or declare myself bankrupt. ACI are fully aware of this but are choosing to ignore it.
    On Wednesday I received an email from TM Legal Services asking me to contact them about my CCJ. As the case was struck out no CCJ was entered against me. I made them aware of this and emailed a copy of the court notice to confirm this. I have had no response.
    I then had an email from ACI asking me to contact them.
    ACI are using one account number and one amount, TMLS are using the account number and amount associated with the CCJ application. As far as I am aware the debt has not been assigned.
    Is this legal, and whatbis the best way to proceed. Arrangements for the DRO are in place, just need to pay the fee.

    When you say the case was struck out, was that in your favour or theirs ? ( ie was their claim struck out or your defence - had they not filed witness statements ?)
    Do you have a copy of the court order striking out the case ?



    If you can paste copies of the emails ( remove personal details) it might assist working out whats going on and help others too.

    I'd also send a CCA request to Asset just to ensure it is the same debt - CCA Request
